"The Transportation Trades Department of the AFL-CIO, which represents workers in every industry covered by the Railway Labor Act, has filed a petition with the National Mediation Board to amend the procedural manual to require a “Yes or No†ballot in representation elections – the procedure in every other election in America.
This is good news for all Delta flight attendants, since our pending representation election puts us at the center of a national campaign by transportation employees to request the NMB to approve a more democratic “Yes or No†ballot.
For too long, transportation employees have been subjected to a “50 percent plus 1†plurality judgment, in which those who do not vote are counted as “No†votes. That’s patently undemocratic, even Orwellian.
The Board will review the TTD petition and give its decision. They will provide a timetable to resolve the ballot question. It is expected that there will be the normal period for public and corporate comment following the Board's initial response regarding the TTD petition.
In updating rules governing elections in our industry, the NMB would be taking a monumental step. These rules were created at the turn of the last century, when rail was the only jurisdiction of the Railway Labor Act. The board can act alone to change the rule.
At stake is the right of every flight attendant to have his or her vote recorded – whether it is a Yes, No, or an abstention. NMB elections for the past 70-plus years have required that a union gain more than 50 percent of the entire bargaining unit.
Many companies have taken advantage of the "50 percent plus 1" rule by padding the ranks of the actual workforce with names of employees that no longer work for the company.
In any case, we can expect the NMB to be challenged by management and certain interest groups that may delay the Delta vote to December, or later. We regret this delay and want to make it clear that we have no desire to extend the election process. However, we will use this time to continue our conversations with Delta flight attendants at every base, explaining how working together will create opportunity and security for ourselves, and success for the world's greatest airline, Delta.
Delta flight attendants are ready, willing and able to negotiate an industry-leading contract that benefits both Delta Air Lines and its flight attendants.
As we go from airport to airport, we are seeing an upswing in support not only from pre-merger Northwest flight attendants, but also from pre-merger Delta flight attendants. Delta no longer can defend its wage and benefit structure, and we have the facts and figures to prove it.
The TTD petition with the NMB comes as Delta faces not only the flight attendant representational election, but also a series of representational elections for workers at Delta/Northwest with the Machinists. A quick resolution is the best in every case, and we will work with our fellow Delta employees in solidarity, members of the IAM and ALPA, to make Delta the greatest unionized airline in the world."
