I couldn't disagree more. It's always been about fairness, otherwise there would not have been a dispute. Final and Binding always assumed fairness in the award and when it couldn't be found uniformly, the dispute elevated to it's current status.

I agree that the perceived fair/unfairness of the award sparked all of this, but I don't think it's where we are with the MOU. To me the MOU seemed to concede that the argument was not being settled and that we needed to take a different path, regardless of how we felt about fairness.

I predict that USAPA will file for an injunction in the DC circuit and prolong the merger integration.
I predict that this ultimately goes to the Supreme Court.
As I have said all along the APA is the enemy.

The fact that is wasn't resolved years ago has only benefitted the legal system. This whole thing has been corraled right into the APA. They don't seem to have the blood lust against the PHX pilots that your fake, failed union has in spades. Don't worry. They'll honor their DFR to you. If you don't think they have, just spend millions of dollars and a decade to see if it's true or not. Of course you'll possibly lose another Billion dollars in lost pay to enjoy your temper tantrum...that's up to you though.

If AAL, USAPA, and APA do not reach a Protocol Agreement because the Company and/or APA require a 3-party ISL negotiation and arbitration, if required, with the West Pilot Class having their own MC and MC Counsel, which will permit the Nicolau Award to be presented to the M-B BOA, what will USAPA do?

Acquiesce to AAL and APA's position and not reach a Protocol Agreement, which could stop the M-B process from proceeding, or something else?

What will USAPA do if no Protocol Agreement is negotiated before the NMB likely designates APA the pilot's union following SCS and then USAPA no longer represents the pre-merger US Airways pilots?
