CONTRACT WORD FOR WORD FACT’S ONLY BY CONTRACT!

US Airways Mechanics:
It’s About Job Security!

When certified by the National
Mediation Board (NMB) as your
representative, the Teamsters
Union (IBT) will protect and retain all heavy
maintenance performed in-house by US
Airways. The IBT will negotiate a new
agreement for the integrated workforce that
protects your SCOPE (job protection) and
brings as much outsourced maintenance
in-house as possible in the future.

Consider these facts:

• By law, the company has to abide by the
provisions of both the existing Teamster
and IAM agreements until such time as
your certified representative negotiates a
new amalgamated agreement with the
merged airline. Furthermore, the Teamster
Constitution requires that agreement to
be voted on and ratified by you;
• The US Airways contract provides
SCOPE protections that cannot be changed
by the company unless your bargaining
representative negotiates such changes.
The Teamsters have no intention of
negotiating this language away under
any circumstances;
• The outsourcing of America West Airlines
(AWA) heavy maintenance took place in
1995, prior to the Teamsters being certified
as the AWA mechanics’ representative.
In fact, In fact, AWA fired 500 mechanics
and outsourced heavy maintenance in
a futile attempt to break the Teamster
organizing drive;

• Relentless legal pressure by the
Teamsters resulted in a decision by the
NMB—which was upheld multiple times
in federal court—that granted the 500
fired mechanics the right to vote in the
successful election that
resulted in Teamster
representation. The
Teamsters then
negotiated preferential
rehire rights for the 500
fired mechanics, and all
of the 500 mechanics
who wished to return are
once again employed by AWA as mechanics;

• Article II-SCOPE of the current AWA agreement states that all maintenance work performed in-house by Teamster mechanics
shall remain in-house and be performed
by Teamster mechanics. Management is
prohibited from subcontracting; this has
been tested and upheld through the
grievance procedure; and
• Together we have an opportunity to return
to the bargaining table and negotiate a
new agreement for the combined group
once the NMB determines who your bargaining representative is. By protecting and
retaining your existing US Airways SCOPE
language, expanding the AWA SCOPE
language and negotiating the return of as
much outsourced maintenance as possible,
we will strengthen the entire membership—
active and furloughed.
Get the facts and expect more
from your union!

US AIRWAYS AMT UPDATE

Seniority Integration questions. A number of you asked what the IBT meant by seniority integration in accordance with Allegheny-Mohawk sections 3 and 13 and that this be accomplished
in a fair and equitable manner. It is the IBT’s view that integration should be accomplished in
accordance with the original Allegheny-Mohawk concept. That concept provides for mechanic
(AMT) date of hire integration with the proviso that no member will be furloughed because of
the merger. That is what we plan to work for. Comments to the contrary are simply meant to be
misleading.

Station visits. IBT representatives will continue to visit your stations in order to hear your concerns and try to answer your questions. It is our intent that an amalgamated Agreement be an
improvement over what you work under today. Your current bankruptcy driven Agreement is
not relevant to the new company and we will bargain to improve the terms of that Agreement.
Although labor peace is important to the company, an unacceptably long contract is not in the
best interests of the AMT’s. Going forward should be a cooperative endeavor and not a one-way
street.

The importance of signing cards. With emergence from bankruptcy, the incumbent union no
doubt will seek a single carrier ruling in order to try to close off continued campaigning. In
order to be represented by the IBT, you should promptly complete and return an IBT representation (organizing) card. A sufficient return of cards will ensure an election, which permits you to choose a new representative. We believe that is in your best interests.

US Airways: Merger with America West may not perform as expected'
TEMPE, Ariz. (AP) — US Airways Group said its acquisition by America West — the cornerstone of its bankruptcy exit — will face "significant challenges" and the combined company may not perform as expected.
While the acquisition will result in certain synergies and growth opportunities in the future, the company said its significant operating losses have not subsided and will likely continue into 2006.

US Airways was acquired by America West Holdings in September as part of its strategy to emerge from more than two years of Chapter 11 bankruptcy protection. The combined company retained the US Airways name.
US Airways had estimated that the combined company would see about $600 million in operating cost savings and revenue synergies. However, in a Securities and Exchange Commission filing, US Airways said Tuesday it "cannot assure" the synergies will be realized.
"We may not perform as well financially as we expect following the merger," the company cautioned.
The integration of the two air carriers "will be costly, complex and time consuming," US Airways said, and management "will have to devote substantial effort to such integration that could otherwise be spent on operational matters or other strategic opportunities."
In a separate filing, US Airways said America West Holdings issued warrants to purchase 386,925 common shares at a price of $7.27 per share. The warrants — a substantial discount to the company's Monday closing stock price of $31.99 — may be exercised any time before Jan. 18, 2012.
The company said it will not receive any of the proceeds from the sale of the warrants.
The new warrants replace those issued in 2002 to the Air Transportation Stabilization Board, an arm of the government, and to AFS Cayman In October, US Airways Group agreed with the transportation stabilization board to buy back all of its outstanding warrants for $115.8 million.

NOTE THE KEY WORDS. While the Acquisition .....US Airways was ACQUIRED by AMERICA WEST HOLDINGS.

 US Airways also could expand aircraft maintenance here, said executive VP of operations Al Crellin.

"Pittsburgh is a strong consideration for us, in terms of adding maintenance," said Crellin, the only top executive to move from the old US Airways.

Whether such work would be done in-house or by a contractor should be decided within six months, he said. The choice depends partly on which union ends up representing aircraft mechanics. The Teamsters contract at America West allows heavy maintenance outsourcing, but the International Association of Machinists contract at the old US Airways does not.

If this doesn't spell it out in black and white for you then I don't know what will!

Not true..

2.2 All aircraft maintenance work, facilities maintenance work and ground equipment
maintenance work performed for the Company shall be within the jurisdiction of the
Union and shall be performed by employees on the America West Airlines Mechanics
seniority list except as provided in Section 2.3 below.
2.3 The parties agree that the Company may continue to (a) contract out work heretofore
customarily or historically contracted out (B) return equipment parts or assemblies to
the manufacturer or to a manufacturer - approved repair station for repair or
replacement, © contract out work when the Company’s facilities and equipment are
not sufficient, or qualified personnel are not available, or where employees available
do not have the experience and ability to perform the work required, (d) contract out
work at any location where such work has not heretofore been performed by unit
employees on a regular basis, or at any location where the Company has not
heretofore maintained permanent maintenance facilities or employees. The Company
shall not, however, contract out work if such contracting our would result in a reduction
in force for any employee covered by this Agreement. Nothing in this Article, however,
shall prevent the Company from implementing a furlough for economic reasons
unrelated to contracting out.

So the IBT wins an election, senority is intergrated and the work you/we currently do stays.

Whats more since we would no longer " heretofore customarily or historically
contractd out" heavy checks we would greive the HP fleet being sent out and get those done in house also. We did this with heavy structures jobs. The company was sending all this work out, and we did some skin changes and now most of the big work stays here in PHX. The still send some stuff out if we are short handed or hangers full.

don't put words in crelins mouth.....he's quite saavy at what he does or they wouldn't have brought him along....
merlin magician also alludes to some very direct points over contractual verbages.the acid test would come in court.Crelin says vote IBT ;)
"The new company said they would honor the contract," Mr. Freiberger said, but, "they didn't like it. They were really upset."

Q. Is it true that IAM representing the US Airways mechanics waived the right to renegotiate their contract provided they are the representing union?
A. We’ll have to defer you to the IAM on this one. Any position that the IAM may take related to the on-going application of that collective bargaining agreement in the merged and integrated operation is a subject that can best be addressed by the IAM.

This was a question posed by someone on the recent webcast. Can an IAM representative factually answer this, please.

IAM contract is up for renegotiation in March 2009.....any attempt to renegotiate it before then would require both company and IAM agreement.at this point in time, the company's point would be to negotiate lower wages and improve on outsourcing ,so there would be no benefit to opening it.

Is this your veiw or is this fact? It sounds like your veiw.
go look it up under RLA section 6...see for yourself. ;)
see you and others are falling for this crap IBT is floating around, that isn't right or fair to the uninformed....takes two to tango...and the company will tango but not at their expense. ;)

DELL we all know the IAM contract is up for renegotiation in March 2009 and you are stuck with it.
The IBT contract is under renegotiation at this time with open items like SCOPE, PAY and more. What better time to get what we want. To read the old and the NEW IBT contract go to www.teamsterslocal104.org. And yes we post our contract online and not hide it from our members

It does not matter that you are in negotiations even the ibt has admitted the IAM CBA would be the surviving CBA, not the ibt's CBA.
