A United States District Court judge in Florida vacated the nationwide travel mask mandate on Monday in a ruling that found the mask requirement for travel via mass transit, planes, and trains violated the Administrative Procedure Act (APA). The lengthy ruling explains how the Biden administration "improperly invoked the order and interpretive rule exceptions to notice and comment," "improperly invoked the good cause exception" to such rulemaking in a manner that "was not harmless error" and how the mandate "is arbitrary and capricious because the CDC failed to adequately explain its reasoning."

In the ruling, United States District Judge Kathryn Kimball Mizelle — a Trump appointee — lays out a lengthy indictment of the Biden administration's rulemaking procedure and its conclusion: "the Mask Mandate exceeds the CDC's statutory authority and violates the APA."

"The Court recognizes the criticism about nationwide injunctive relief and admittedly shares some of the skepticism about it," the ruling states before explaining "the weight of authority and judicial practice instructs that vacatur is an appropriate remedy for an APA violation."

"The Mandate exceeded the CDC's statutory authority, improperly invoked the good cause exception to notice and comment rulemaking, and failed to adequately explain its decisions. Because 'our system does not permit agencies to act unlawfully even in pursuit of desirable ends'...the Court declares unlawful and vacates the Mask Mandate."

As a result of the ruling, the Mandate is remanded to the CDC "for further proceedings consistent with this order" and airlines, railways, rideshares, and other public transportation entities are — for now at least — no longer required to enforce the now-vacated mandate.
 
Good. It’s 2022. Time to fight COVID through that lens and not the one we were using 2 years ago.

FWIW, I flew last night. In the terminal, it was ~70-30 in favor of not wearing a mask. My flight looked to be ~50/50 (based on my watching people board).

Walensky was working on eliminating the mandate too, and the courts intervened, then Biden intervened, blind siding Walensky.
Now Walensky supports the Biden appeal.

Amazing how that works, 'eh?

This gets appealed to the 11th Circuit, which is overseen by Justice Thomas....

Current makeup of the court is six Trump appointees, three Obama appointees, and one each from Clinton and Bush 43.

Something tells me that's not going to be a very welcoming environment to appeal, but they went forward regardless. If by some chance the luck of the draw works out to be against the plaintiffs (2 Obama judges and 1 Trump?) an appeal to hear en banc will certainly flip the ruling back to upheld.

Yeah, I know. Judges aren't political, but being a textualist vs. a living document judge tends to depend on who appointed you.


Best case, this gets appealed and the government has to answer for why it wasn't an emergency on Tuesday but became one on Wednesday...

Arguments will likely fall during the lead up to the mid-terms. Can't wait to have masks be the distraction during those Georgia Senate races.
