Most Charges Against AA and APFA Dismissed

A group of AA F/As brought several charges against AA and APFA for issues over voting and other irregularities that occurred in the Spring of 2003 during negotiation of contract concessions. In her ruling today Judge Gershon dismissed 8 state law claims, the RICO claims and all but one LMDRA claim. Therefore, it appears AA and APFA are largely out of the woods.

Yes, the RICO complaints were dismissed because they did not meet the rules to be called a RICO complaint. The State Law claims were dismissed because you cannot file suits for damages in Federal Court that refer to any or all parts of a labor contract, such claims must be filed under the RLA. The labor management act claims were mostly dismissed but for one section of Claim 13. They were not rejected for lack of evidence except for the RICO claims. Just like the TWA F/As, they, at least in part, filed in the wrong venue.

Indeed the Judge did rule, but she did not throw out the charges that APFA violated its own constitution in the ratification of the RPA and that the TWA F/As were treated disparately through this illegal ratification process.

The parties continue depositions. It is not quite over. Most likely parts of Judge Gershon's decision are in error. It is likely to be appealed. APFA will try to present this as a big victory but everbody knows they violated their own constitution amongst other things.

Well sometimes you have to make corrections before you can move on, looks like thats what they are trying to do.
