Things are getting out of hand, a retired police officer shooting someone over texting his three year old daughter during previews.

Still not condoning what happened but , it wasn't like the 71 year old, retired police officer said "Drop the phone or else"!
 
He actually asked the dude to put his phone away "TWICE" and when that didn't work, he went to get the manager, who was apparently too busy to be bothered. A confrontation ensured when the 71 year old retired police officer asked a 3rd time and apparently felt threatened by the much younger phone abuser!

The movie wasn't even on yet, genius. It was during the previews. The theatre doesn't even dim the lights and admonish you to silence your phones until after the trailers, smart guy. Has it been a while since you attended a film screening, or what?
 
And by the way, it doesn't even say "turn OFF your phones." It only asks you to silence them, so the guy wasn't even doing anything wrong.

I went to see The Hobbit this past week and they did have an admonishment about a bright phonescreen Iin a dark room. In other words. Turn off your ringer and put your phone away.

I think it is common courtesy that when the lights dim you should put your phone away. If you need to answer a text or take a call, just go out side.
