RegionsAir May Sue FAA
For Breach Of Contract
RegionsAir could become the first airline to sue the
FAA for breach of contract, if a lawsuit against the
agency is filed with the federal claims court today, as
some speculate.
At the heart of the claim is the consent agreement
signed by the carrier earlier this year that later led to
its grounding (DAILY, March 13). Regions argues
FAAentered the agreement in “bad faith†with an eye
to terminate its certificate. The carrier wants the
claims court to void the deal and award it $10 million
in damages, plus interest, and attorney’s fees.
Regions temporarily and voluntarily ceased operations
in March at FAA’s request, as the agency wanted
the carrier to ensure that training and qualifications
for pilots and check airmen were up to date (DAILY,
March 6). The carrier quickly complied with the
request and “re-commenced [operations] with FAA’s
consent.†But a few days later, a host of FAA inspectors
descended on the airline’s regional headquarters
to investigate Regions’ operations.
