1. Opinion and Award
a. The Opinion and Award of the Arbitration Board shall be made and written in executive session and shall bear the signature of the Arbitrator (Chairman of the Arbitration Board). Such Opinion and Award shall be issued simultaneously and within fifty (50) days following the convening of said Arbitration Board unless extensions are agreed to by all parties to the proceeding, including the President. Participation in executive sessions shall be limited to Arbitration Board members only and the Arbitrator shall decide all issues. (AMENDED - Executive Board May 1998; Executive Board October 2001)
b. The Award of the Arbitration Board shall be final and binding on all parties to the arbitration and shall be defended by ALPA. The Award shall include any agreements reached at the mediation step. The Arbitration Board will include in its Award a provision retaining jurisdiction until all the provisions of the Award have been satisfied for the limited purpose of resolving disputes which may arise between the pilot groups with regard to the meaning or interpretation of the Award. What does the wording of FAR part 91 have to do with the arbitration situation?

The windfalls given to AWA will have to be fixed in a joint contract, or the west division will remain a separate operation for some time. One list, separate division, just like MDA. Good luck with that. B)

How can the arbitrators "opinion" be imposed when ALPA merger policy was blatantly violated?

I can't belive that ALPA, in all of their wisdom, wouldn't include some kind of caveat (not included, of course, in your narrow selection from the manual) for approval or appeal. Even the US government has those things.

Preserve jobs?? Advantage EAST ( as a result of AWA you now have a job) Also brought back your unemployed!!!!!!!

Avoid windfalls advantage EAST (517 go DOH and fence out AWA from even NEW WB flying not current on the property)

So tell... what are your advantages in five to seven years? West will own the airline through attrition. So you don't think its fair to let a 30 year captain keep his position and finish the few years he has left in his career with some peace. Then when he retires you will have your chance at those wide bodies.

Until these few East pilots truly realize their self worth, get over their sense of entitlement, and come to grips with their pre-merger career expectations and the state of affairs at their airline; there is no sense in debating anything. As for the binding arbitration award, it is a direct result of these issues resulting in a total lack of flexibility and bargaining when it mattered.
