According to news reports, the defendent claims to have consumed 3 beers in 2 hours, which resulted in a Blood Alcohol Content of .096%

By plugging those numbers in various BAC calculators, assuming a 180 pound male, and US beers, the BAC level
is around .024%, way below the legal limit for motor vehicle operation. (Of course various light/imported beers and different body weight will alter results slightly.)

The Drink Wheel shows 6 beers in a 2 hour period giving a BAC of .087%, 7 beers slightly over .10% These results also do not take into account the time required for BAC testing.

I believe the report stated DP was 6'3" and 220 pounds.

3 Beers
1-What size were the beers, 24-32-48 oz beer?
2-What kind of beer? Budweiser, Miller GD are 5% Alcohol
Some of your Micro-Brews can go up to 17% Alcohol
3-Did he have any food in his system? Food can absorb some, an empty stomach it would be amplified

I tried figuring that out years ago and I came to this conclusion, there are times that when I drank, I would start feeling drunk/buzzed after 2 and some days I could drink 6-8 beers before feeling that way. Another thing is that if you drink on a regular basis, you build up some tolerance but you don't drink, that person can get drunker faster.

I told you, they passed around the snack basket at the event, but there were no XOXO's in it, so he passed.

Granted, if I had 3 beers in Munich during Octoberfest, I'd be passed out, however, when talking to a cop in the US at night, in a car, a general consenus would be 12 ounce beers. I doubt if I'd say, "yeah, 3 beers, those great big ones with no big foamy heads!" Ask a cop sometime if the 'reported' drinks generally equal BAC levels or motor skills level of impairment.

I am glad to see that you are all EXPERTS in criminal law and specifically DUI.

i don't know, they may know more about DUI than you know about deflimation

Speaking of math...did you all see where LCC BOD Richard A. Bartlett sold a ton o' shares worth millions, just after Doug was DUI? I lost count of the millions.

Coincidence? Makes you wonder what the BOD knows. I did notice that the stock tanked at the end of the day when the story broke.

According to the FBR Open website, Coors Lite and Heineken were also sponsors of the event and most likely served.

US Airways lays out one of the fanciest spreads.

The Tempe-based company leases an oversized tent able to comfortably serve 350 people a day.

The invited guests belly up to a 32-foot solid oak bar with a couple of flat-screen TVs for those who would rather tune in to some other sport. The visitors dine at the same plastic tables as the rest of the Corporate Village crowd, but Kathi Overkamp, US Airways manager of special events, covers the plastic furniture with fancy tablecloths and fresh flower centerpieces.

It doesn't matter what was said regarding alcohol consumption......only thing that counts is his BAC and it was 0.096%.See you in court.

What's deflimation?

I've heard of delamination and defamation, but "deflimation?" That's got me stumped.
