Perhaps Smisek will not be charged, but the story you linked is expressly limited to the UA corporate entities, and does not apply to any individuals:

Agree. The plea agreement seems to be limited to the corporation's liability.

Smisek doesn't appear to be cleared, nor do the other two officers who were forced to resign.
