Passenger tries twice to light a cigarette on Alaska flight. Diverts to ORD

Red-eye flight from SFO to PHL diverts to ORD to remove passenger who tried twice to light a cigarette. Smoker removed from airplane by police. Flight delayed an hour because of need to refuel after diversion.

However, no report that passenger was arrested???? Article seem to say that everyone-crew, airport security, Chicago police--thought that someone beside them was responsible for next step action.
Why am I not surprised?

Doesn’t the crew have to file the report first, or no?
