The Hawaii Supreme Court has ruled that a jury should decide whether Aloha Island Air was wrong when it let go a pilot who is blind in one eye.

The Supreme Court ruling yesterday says that a trial should determine whether the airline has to pay a one-point-four (m) million dollar fine for employment discrimination.

It has been 16 years since the pilot, Bruce Pied, was turned down for a position at Aloha Island Air even though he had a Federal Aviation Administration waiver for his monocular vision.

The airline, which was sold and renamed Island Air, has said it wasn't discriminating against Pied. The airline has said it was following its policy of not hiring one-eyed pilots.

Pied's attorney, David Simons, says the Supreme Court decision only further delays the long legal process.

Island Air officials were not available for comment.
