Being a good Samaritan in California just got a little riskier.

Notably, some people are more prone to react instead of thinking first.
If I were to do the same thing, I ‘may’ deserve to be sued; due to my training, vocation, having worked under pressure and having some knowledge of how things work.
I do not know the knowledge or excitability, rational behavior, etc… of the person in question but I do believe that she was reacting to what she believed to be a life threatening event.
Given her training and knowledge (or lack thereof) one might accept her reaction more so than me or many of the other people in the Aviation field.

Most undoubtedly, her best course of action would have been to jump up and down screaming ‘OH MY GOD, YOU ARE GOING TO DIE!’… :wacko:

The ‘message’ to everyone from this point forward is to not be involved and do not take action.

This just sucks. Did some ambulance chaser get into her head after the accident and convince her that she was wronged???

Barring some proof of conscientious and intentional malfeasance, I seriously doubt any jury would find in favor of the plaintiff. We I on the jury and no evidence were provided to prove that the person who helped her was trying to do anything but try to help her, just to piss her and her lawyer off, I'd find him guilty and award her $0.01 for damages. Let her lawyer take 50% and she can suck on the rest.

I wonder how many people will die or get injured because people are too worried about getting sued. Iwho the CA legislature steps up to the plate and passes some laws countering the SC's stupid decision.
 
Then don't bother with all that book-larnin. You do not have the lawyer gene. You would never make it. :lol:
