He's 85 years old and please don't get me wrong here but he may have given over his duties to his clerks. Which is not unusual yet, they may not have truly understood the ramifications of their brief.

My Grandparents gave up their drivers liscenes when they were in their 70's because they knew they couldn't or shouldn't drive. And they where sharp as tacks.

He may be still sharp as a tack in some areas but not here and not with this award.

He needs to step down.

Speaking as a casual and totally objective observer, I say he is not.

Back in December I asked one of the merger commitee members their opinion on Nicolou. This individaul was very impressed. He said that the arbitrator was obviously very sharp and engaged. He was impressed.

Your a newbie, what do you know? I haven't been a newbie since Tuesday.

Justice John Paul Stevens is 87 and remains one of the most highly regarded Justices on the Supreme Court. Nicolau at 85 is going early.

The US MEC and pilots who thought this had a snowball's chance of going DOH are not mentally competent.

If you want to know why we got no credit for attrition due retirement look in the mirror.

Why don't you guys challenge his mental competence in court.

In fact, I dare you to.

Good question and I'd love to see their attorney squirm as he presented the argument, but it likely would never happen since the East never raised the issue during the proceedings. Now, they are estopped from challenging competency. But it is a fun thought!

I think there may be a valid legal issue here.

This award is too bizarre not be looked at and I think there is something askew going on here.

Anyone who read his US/Shuttle or FedEx/Tigers awards shouldn't have been surprised by this award and he was quite a bit younger when he arbitrated those.
