Lawsuits on the way.

Lawsuits make complete sense from a realist perspective … with the us economy in the tank , why NOT sue , what does one have to lose ? I advise all of my friends that if they are terminated from their place of employment to sue , regardless of the reasons involved , with the job market as tight as it is , you get fired you won’t be getting another job , so sue …. It’s the same principle with this flight … if you’ve got nothing to lose , that only means that you have everything to gain …

Us airways needs to use the lawsuits to it’s own advantage , we need to play them up … it’s like free press coverage , the population will be on our side and feel sorry for our company and feel outrage at the suing passengers .. We’ve got to keep the us airways name out there ! Pound the streets and the airways with us airways branding! Capitalizes on this situation !
But if the person suing their employment that fired loses that hearing, how will that make that dude look? not good in my opinion. Now as for this case, I personally dont see how they could win a suit Id be happy just the fact to walk off the plane. After all it wasnt USAIRWAYS, CREW, Airbus, or related employees fault. The birds flew in and attacked the plane But I sure would encourage this airline to use the lawsuit to their advantage regardless afterall they already take advantage of their own employees in hard ways
 
I guess saving a person's life isnt good enough for people anymore. It is becoming a sickworld nowadays...
 
We are a litigation nation and someone has to pay for the Kettles misfortune of staying alive. They can't file a claim against the geese...ore can they?

Are the PETArds suing on behalf of the dead geese, yet? :lol:
 
Remember, suits can be filed without US being a defendant - the engine manufacturer, Airbus, Port Authority, FAA, whoever has deep pockets. Having said that, I expect that US would be named as well.

It's been almost 8 years since I went to my HpEART (SAL/Care Team) class, but I could swear they said that Federal law prohibits attorneys from initiating contact with passengers for 45 days after a crash. With this and the above quote in mind consider this. How is it that "several" passengers found the same firm in NYC? This is NEW YORK CITY! There's literally THOUSANDS of law offices, and likely HUNDREDS that would take this case. Yet "several" passengers (presumably all the ones that are interested in litigation) found the same one? You've got a better chance of making ice cream in hell that that happening.

No surprises here unfortunately. Joe Hart's comments surfaced a few weeks ago actually, and it's an absolute joke.

Six flights in 2 weeks after a "traumatizing" experience...then guess what? DON'T FLY.

I refuse to believe his company would not honor a request on his part stating that he would like to avoid air travel for a while because of the circumstances, if he had asked for one.

I had a headon years ago. I didn't, couldn't, drive for almost two weeks. Not for physical reasons, I was luckily fine other then minor injuries, but because of mental issues. Cars scared the crap out of me. I got over it. If this guy is really that sensitive he needs some help for the PREEXISTING condition called "being a chicken%@&*".

Easy. You can build an Alienware laptop for $9000 without even blinking. Even thinking more modestly:

Laptop: $1500
Digital Camera and lenses: $2000
Two quality suits: $1500
Good shoes: $200

And I'm not even trying...
 
They're only blood suckers until it's your assets on the line. Then all of the sudden they become your personal freedom fighters.

US is an easy target, because it was their aircraft which ended up in the Hudson. It's a darn shame, because US did nothing wrong. I doubt that any of these lawsuits will hold any merit, though. US may end up settling out of court to avoid lengthy legal proceedings, but I really cannot see them losing any lawsuits over this. Two words: "Force Majeure."

"Force majeure". Law. an unexpected and disruptive event that may operate to excuse a party from a contract. "Force majeure" = synonymous with Stephen Wolf and et al.......

Well, there's a "clause" that shouldn't be uttered on this forum. 🙁

People can file suit, but I don't see any trier-of-fact awarding damages unless the fact pattern changes a whole lot from what we now know.

Well said and I completely agree. Filing a lawsuit is a very different thing from having a viable theory for recovery. All these lawyers have to worry about is skirting around Rule 11. And in this case, filing a lawsuit probably doesn't violate that rule, as they can probably articulate some basis for the suit.

Does the $9000 Alienware come with a blonde. Your average laptop is about $700. I can attest, someone traveling with what you describe, is not your average US passenger.
 
Mankind is Very unpredictable.
If it turns out be be, that Less passengers file, as opposed to those who do, then at that point we'll know if we've won a moral victory
