Court: US Airways can use outside maintenance company

PHILADELPHIA - A federal appeals court on Tuesday lifted an injunction preventing US Airways from hiring an Alabama company to do maintenance work on 10 jets based at Pittsburgh International Airport.

The airline has been arguing with the International Association of Machinists and Aerospace Workers over whether farming out the work violated the union's contract. Maintenance on US Airways jets has been performed exclusively by the airline's employees for 54 years.

By a 2-1 vote, the 3rd U.S. Circuit Court of Appeals overturned a judge's October decision to temporarily block the airline from giving some of the work to Singapore Technologies Mobile Aerospace Engineering Inc. of Mobile, Ala.

The court ruled that the labor dispute was minor, and that the planes could be sent south for work while an arbitration board decides whether similar work can be performed by outside companies in the future.

Federal laws governing airlines and their employees mandate that in the event of a "major" dispute about a union contract, both sides are barred from taking any action that would change the status quo until the disagreement is resolved.

US Airways said it needed to hire an outside company to perform the work because it lacked the buildings and equipment needed to overhaul the aircraft itself. International Association of Machinists General Vice President Robert Roach Jr., the airline's argument "frivolous."

"We will not allow the airlines arrogance and disregard for the employees that rescued the company to go unchallenged," he said.

US Airways spokesman David Castelveter said work on one of the planes is already complete. The remaining nine will be sent to Alabama soon, he said.

This is another example of the current anti labor government we have in this country. The judge ruled that this is a minor contractual violation. Well this minor contractual violation will have a major affect on the people that will be layed off.
Since when is a contractual violation that results in lost jobs anything but minor?

I hate to see what other contractual agreements are considered minor.
This is another step backwards for the unionized working person.

US Airways mechanics to appeal outsourcing ruling

WASHINGTON, Feb 5 (Reuters) - Mechanics at US Airways (NasdaqNM:UAIR - News) said on Thursday they would appeal a court ruling permitting the airline to hire a private contractor to do maintenance on its planes.

The International Association of Machinists said it would seek a decision from the full 3rd U.S. Circuit Court of Appeals in Philadelphia.

A three-judge panel from that court ruled 2-1 on Tuesday that a temporary federal district court ban on maintenance outsourcing was not valid because the lower court lacked jurisdiction to consider the matter.

The panel's decision did not determine whether outsourcing violated the union's contract and said the issue should be resolved through arbitration.

But the union said it chose to seek a rehearing from the full 13-judge appeals court rather than arbitrate the dispute with the No. 7 U.S. airline.

"This issue is too important to allow a split decision by a three-judge panel be the final word," said Thomas Buffenbarger, union president.

A majority of the court must agree to rehear the case for it to proceed.

In October, U.S. District Judge Robert Cindrich permitted a private contractor to complete maintenance on one Airbus (XETRA:EAD.DE - News) plane, but he blocked plans for work on nine more.

The union claims its contract requires US Airways to use union mechanics to perform heavy maintenance. The struggling airline has sought outsourcing in order to cut costs.
