Rep. Wilson Outburst Leads Senate Dems to Close Loophole in Health Reform Bill

In the Senate, Democrats in the so called "Gang of Six," began moving quickly to close the loophole Rep. Joe Wilson helped bring to light with his outburst during President Obama's address to a joint session of Congress on Wednesday night.

Among three House committees to pass bills for health reform, only one expressly bans federal funding for proving health coverage to illegal immigrants.

"The Congressional Research Service has indicated that indeed the bills that are before Congress would include illegal aliens," Wilson said. "And I think this is wrong."

Indeed, the nonpartisan Congressional Research Service study found that the House health care bill does not restrict illegal immigrants from receiving health care coverage.

House Republican Minority Leader John Boehner amplified the complaint that without proof of citizenship, illegal immigrants could be insured.

"There were two opportunities for House Democrats to make clear that illegal immigrants wouldn't be covered by putting in requirements to show citizenships," he said. "Both of those amendments were, in fact, rejected."

In the Senate, Democrats in the so called "Gang of Six," a group of bipartisan senators on the Senate Finance Committee which is the last panel yet to release its bill, began moving quickly to close the loophole that Wilson helped bring greater attention to.

"We absolutely assure that those who are here illegally would not get the benefit of any of these initiatives," Sen. Kent Conrad said.

Perhaps it is you who needs to focus and quit playing a wannabe Perry Mason. Focus on the word "enforcement".

Read the CRS report on ObamaCare's treatment of illegal immigrants.

In its subsection on health insurance subsidies (known as "affordability credits"), HR 3200 does state, "Nothing in this subtitle shall allow Federal payments for affordability credits on behalf of individuals who are not lawfully present in the United States." That would seem to solve the problem, but it's more rhetoric than reality.

The bill contains no verification requirement or enforcement process for citizenship or legal residency, as exists for other federal benefit programs. The only verification required for the subsidies pertains to family income.

Beyond that, as the CRS report notes, everything is left in the hands of the Health Choices Commissioner.

House Democrats defeated all attempts in committee to add an enforcement mechanism that would require proof of citizenship or legal residency for those getting subsidies.

Whatever the final bills say I think the next thing Barack wants to tackle is making sure all illegals are legal. It makes him not a liar and increases his voting base. A win, win for him...........

And counselor....under the equal protection provisions in the Constitution it would be un Constitutional to provide government health care to one class of people living in the United States while denying it to another class of people living here illegally.....
Obama claims they won't be covered....he is a bald faced liar and he knows the Constitutional Law in this regard.

One would think that an aspiring student of law would know the difference in what is stated and what is not.

The bill missed one important feature. That would be enforcement. A law is useless unless there is expressed language of enforcement. The WH has also admitted that this is true the two days after the speech!

Is this a kangaroo court or what?

I would definitely agree: It would be nice to see actual language that provides the mechanism for verifiying immigration status for health credits rather than leaving it solely to the Health Choices Commissioner to determine such mechanisms at a future date. Nonetheless, there are plenty of statutes that leave the details of actual mechanisms to those responsible for "enforcing" the laws. Indeed, it is not the duty of Congress to enforce such laws. Congress makes the laws for others to enforce. Some guidelines in enforcement could be appropriate in this situation though.
