ALPA MEC Chairman's message - October 7, 2004

This is your MEC Chairman, Bill Pollock, on October 7th, with an MEC Chairman's message to the pilots.

On Tuesday evening, at a special MEC meeting, the MEC voted to send the Transformation Plan tentative agreement out to you for a membership ratification vote. That vote was a watershed event for the pilots of US Airways, and we can now concentrate on becoming educated on the provisions contained in the TA and casting our votes.

Before the ballots open and the road shows start, let me explain the important matters going on in the bankruptcy process. The Company is still seeking 1113(e) interim relief, and the hearing on the Company’s 1113(e) motion will still be held this afternoon. However, we have an agreement with the Company during the ratification process. If the judge grants the 1113(e) motion before we get the results of the TA vote, and the TA is then ratified by the pilot group on the 21st, and approved by the court, the provisions of the TA, not the 1113(e) interim relief, will become effective.

The date that LOA 93 becomes effective depends on what happens first: the date that LOA 93 is ratified and signed by ALPA President Captain Duane Woerth, or the date that the judge grants the 1113(e) interim relief. As way of example, let’s say that the judge grants the Company’s motion on October 12. The 1113(e) provisions will not take effect. Instead, the Company will wait to see if the TA is ratified on October 21st. If it is ratified and signed on the 21st, and if the TA is approved by the Bankruptcy Court, then the provisions on LOA 93 will become effective, retroactively, on October 12, the date that the judge granted the relief motion.

If the TA is voted down on the 21st, then the 1113(e) interim relief will be implemented and effective on the date that it was granted by the Court.

We’ll be keeping you updated through the code a phone and website on the Company’s 1113(e) motion and any actions resulting from the motion.

If you’ve looked at the TA, which is on the pilots only website, you know that many of changes that are proposed in the TA will adversely affect your pay, retirement benefits, scope and work rules. They could, in fact, lead to the furlough of junior pilots. However, the conditions established in the TA are less onerous than what may be imposed through the 1113(e) and 1113© process, a process that would establish permanent contract relief, first on an interim basis and then on a long-term basis. According to our advisors, the long-term relief would likely contain provisions no better than the TA. We have been clearly advised that the 1113 process could produce provisions that would be far worse.

In addition, as our financial advisor has stated, the risks to the Company become even more significant if we proceed without a consensual agreement.

It’s your decision to make, and it will not be an easy one. However, I am glad we can determine our future. Balloting materials will be sent out shortly with information on when balloting begins and ends. Read the education materials that will be sent to you shortly, attend a road show, and call the Comm Center, which will be activated soon.

I want to thank all of you for displaying so much interest in these negotiations. Over 100 pilots and spouses attended Tuesday’s meeting, and hundreds of pilots have attended previous MEC meetings during the past month.

Please continue to use the code a phone and website so that you know when to expect balloting and education materials and the hours that the Comm Center will be operating. The road shows will take place in CLT, PHL, BOS, DCA and PIT.
