Interesting article:

"Why NBA may need to lawyer up if it proceeds to kick out Donald Sterling"

"This isn’t the first time the NBA’s advisory committee, after hearing Sterling’s words on an audio recording, has voted unanimously to boot Sterling from the NBA's ranks. Indeed, the whole incident elicits a 30-year case of déjà vu – and perhaps a sign of the legal battle to come."

Banning him was effective enough to quell the dissent with the players union. The fact is he's 80, fighting prostate cancer, and will be dead at some point (sooner than later from the looks of him).

Silver may be on a witch hunt, but is it really worth it to the other owners to set the precedent of forcing an owner out, knowing it could turn into lawsuits and even more ugliness? What potential can of worms and exposure does it open up for the rest of the owners who might have their own warts & skeletons?...
ultimately it's a win /win for Silver he gets instant cred if you will as new commish and if Sterling fights it he likely be dead and it not matter sooner rather than later

If that's the case, than on what grounds does the NBA have for booting him out?  Like :E" stated, they know about his feeling towards  blacks for years.
As 700 has pointed out several times, the law has nothing to do with the NBA.  I would think that lawyers for the NBA have told the commissioner (or what ever) that he is on solid grounds for his actions against Sterling.  More than likely there is something in the contract that allows this or it might even be similar to a 'at will' situation where with a majority vote your butt is out for what ever reason they want.  I have no idea.  The still has nothing to do with the US legal system.  The NBA is a private business and they can do what ever the heck they want.  I could care less.  If the girlfriend (or who ever she is) violated the law and Sterling wants to go after her that is up to him and a separate issue entirely.

You really think all the owners have just decided willy nilly to boot his butt to the curb?  Do you really think none of them called up their legal dept and asked a question or two?

Sure Sterling can file a law suit, anyone can for anything.  That does not mean it has merit.  Given his age and the amount of money it is worth I hardly think it would be worth the effort on his part.

Now are you trying to second guess what he'll do Tree? You got an inside track to him do you?  Like I said before, it's not about money with these people, it's about image!

Really?

Oh, this is so far from over.

Both the ex-girlfriend and TMZ could be sued for civil damages, and I do expect that Sterling will be fighting the NBA in court.

I have zero expectation that the Los Angeles DA would bother to file criminal charges.

In court, Silver's ban and fine will wind up being largely unenforceable. You can't prohibit someone from being involved in a business they own. About the only thing they can do is block Sterling from participating in league meetings.
y.
NBA can try to fight this, but since the tape was illegal, it's fruit of the poison tree; the ex-girlfriend's version can't be corroborated, since it was a private conversation, and absent admissible proof his conversation took place, the NBA can only point to hearsa

Sterling's got deep enough pockets that this will get dragged out to the NBA's detriment. His lawyers won't care about the nature of what he said as long as the invoices get paid. Sorta like nobody really cared about his previous acts of racism as long as the checks he wrote to the NAACP and his Democrat candidates cleared the bank...

Make no mistake - the guy is a dirtbag, and he'll be dead before any of it gets resolved.

You don't get it do you 700?------  There's a good probablity that what was said, was said in a private conversation, and illegally recorded! If that in fact is the case, it can not be admitted into court, and whoever leaked it to the media, can be sued for damages!!!! $$$$$$$! ----- Now, Mr. Sterling already said, his team is not up for sale. And I don't believe he's the type to just role over and take all this without a fight! And he does have the resorces to do just that! It could get intesting!

Geez.  We all hypothesize whats going to happen.  Never said I had an inside track any more than you or Eolsen did.  My guess is no more or less valid than yours is.

And the LA DA came out and said they are not going to charge her with any crime in regard to the recordings.

That's right! ------- There has to be a complant filed against her. if Mr. Sterling doesn't file a complant, the D.A. can't charge her! Obviously he hasn't chosen to do so! But I'de be surprised if he doesn't go after the person who leaked it to the media in Civil Court!

So now you know what he is going to do? Didn't you just accuse me of the same thing?

I'm sure most of the owners got an initial indication based from NBA counsel on the limited information NBA had at the time. As more details emerge, and the lawyers from the owners start to look at the details and talk to each other, a different opinion may emerge.

Given his age and the amount of money, he also has nothing to lose. Money stops being a motivator when you've got enough of it.

I seriously doubt that the owners took someone else's word for it. I do not have nearly as much net worth as any of these guys and I don't trust others to make those type of decisions for me. I would be amazed if they did not have their lawyers all over this.

That is true. He my do it just for spite or chits and giggles. He also may value his legacy (what's left of it) and not pursue it.

According to what 700 posted regarding the contract it does not sound like Sterling has a leg to stand on.
