Is there a group that does look at violations in the union.

Why! Does the IAM think they have accomplished anything at all by resighting that they will not allow vacation time mandatory against FMLA. That! is so insignificant. I, Lithuanian could've proved That. Get on with real STUFF, IAM. You make Bigger bucks Then that kind of subject entails. NEXT!

Does US AIRWAYS force employees to use vacation with FMLA? I wasn't aware of this and I'm not sure if the victory by the rail unions will change anything on US AIRWAYS property. If your company does force vacation time then the victory from the rail unions should benefit workers at your company.

never did on the west side. just sick time anthing more than 5 days went to short term disbility.

Yes they do force you to use all vacation,dats,comp days before going on unpaid FMLA.This may not seem like a big win to some folks but in realy is for the IAM and the unions.
There are many things under FMLA that are in relation to a collective bargaining agreement.
This one in situation in particular is were the precident is set in regards to the contract having more power for the worker.If your under a contract it is the final word in many matters in regards to FMLA,the company has always just done what ever it wanted to.
USAIRWAYS has been visited by the good folks in the gov that oversee FMLA many times.
The FMLA act has been treated like a joke with this company.
This will set standards on what they can and cannot make you do now..and its been a long time coming,so yes it is important,not trivial..good job unions a first step in getting going back our way. :up: :up: good job :up: :up:
 
allstrike, your are correct, what ever is in the CBA is what will take precedence, unless it is not explicitly covered, it will be goverend by the FMLA. example, on the west m&r, the ibt cba allows you to use your sick days to care for an immediate family member, one may have to furnish a doctor's note or similar to provide for the need, but it can not be denied if there is just cause.

Under the FMLA a man can take up to the max allowed under the FMLA to bond with a newborn child, and or care for the mom who may have to to recouperate.

The FMLA is needed but not as much as for a union member that has many rights under their CBA, the FMLA is really necessary for those that have no union and is at will of the employer, that is who the FMLA is really aimed at.

lastly under the time off during an FMLA absence the mployee may use at their discretion or by the cba any unused paid time but this time runs CONCURRENTLY with the days off under FMLA
