US Airways plans to ask a judge to approve its exit from bankruptcy court and subsequent merger with America West Airlines at a Sept. 15 court hearing, according to court documents filed late Monday. That timeline would position the airlines to close on the merger in early October, assuming the merger plan wins approval from America West shareholders, US Airways creditors and a federal loan board. The airlines have said they hope to have a deal completed around Oct. 1, although integrating the companies is expected to take a few years.

If it taker Mr. Parker a "few years" both airlines will cease to exist.
 
According to ALPA communications committee chairman Jack Stephen, "US Airways filed several motions this week in bankruptcy court. As we have previously reported, on August 9, the bankruptcy court will hold a hearing on whether to approve the Disclosure Statement. ALPA and all other US Airways creditors, investors and unions have until August 2 to review the Disclosure Statement and file any objections they may have to the adequacy of the information in the Disclosure Statement. The Disclosure Statement describes and explains the terms of the Plan of Reorganization. If the Disclosure Statement is approved, it will be sent along with the Plan of Reorganization and ballots to impaired creditors, which are generally creditors who will not be paid in full, for them to vote on it. Following the vote, a confirmation hearing will be held on whether to approve the plan itself. At the August 9th hearing, US Airways will ask the Court to set a confirmation hearing on the Company's plan of reorganization for September 15, with objections to confirmation and ballots due on September 12."

Separately, it's my understanding that the SEC, DOT, and ATSB have given US Airways and America West a verbal approval to consummate the merger. Expect formal approval's to be publicly announced in the not-to-distant future.

Meanwhile, bankruptcy emergence and the merger should be completed within the first few days of October, provided Arnold & Porter can complete all of their required work on time and there are no hiccups.

Not quite the last minute, but thus far it's MidAtlantic employees.
