MEC CODE-A-PHONE UPDATE
February 28, 2003
This is Roy Freundlich with a US Airways MEC update for Friday, February
28, with one new item.
The bankruptcy court hearing on the Company''s motion to terminate the
pilots defined benefit plan recessed this evening at 6:20 p.m. and is
scheduled to reconvene tomorrow morning, Saturday, March 1, at 9:00 a.m.
The court proceedings are progressing slowly which has resulted in the
extended schedule. ALPA''s objection to the Company''s motion is scheduled
to be heard tomorrow.
A report on today''s activity is being prepared and should be announced
later this evening or by tomorrow.

Group:

The company completed its case today and put the Towers & Perrin actuary, John Lutz from the Seabury Group, and Dave Siegel on the witness stand. The day had direct and cross-examination and ALPA has yet to put on its case.

Then, James Kenney, an actuary who testified on behalf of a group of independent pilots via videoconferencing, told the court the company's projections about its liabilities are overstated by more than $500 million. That, along with a freeze in benefits that would save about $350 million, would eliminate the need to terminate the defined benefit plan.

After ALPA's case is presented and we have cross examination, the parties will provide closing arguments and the court may rule from the bench tomorrow afternoon or the judge could write an opinion and award shortly thereafter.

ALPA needs pilots to attend tomorrow's hearing in uniform and I am asking any pilot available to do what is necessary to attend.

Typical Mangement to OVERSTATE the liability or delimma for that matter. I'm telling you guys, this type of manuevering is typical. THIS MANAGEMENT WANTS THOSE PENSIONS. PERIOD. You watch, ALPA will prove that this mangement is over exaggerting the problem!

PITbull girl, I love your style and your mind. Up until a few days ago I thought the fat lady had sung. Turns out, she only took her clothes off and what a horrible sight! She's not a she; she's a he! The Mar 1 codaphone is a big clue.
What I really find difficult to comprehend is how those guys thought they could actually pull the wool over a bankruptcy judge's eyes! This still may not go the way the pilots want it to, but if it does, airline management will be chastened. They will have to take their grubby hands off of money that has already been earned by their employees.
I don't think the "L" word will work at U anymore. But there are still other airlines lined up right behind U and they are holding their collective breaths that the judge was just throwing the pilots a nice-nice bone.
