UAL will ABSOLUTELY with 100% assurity, meet the Oct DIP requirement.
The IRS "refund" is irrelevent to the DIP covenent (The "T" in EBIDTAR stands for TAXES)
I don't know how UAL counted the TSA money. some airlines counted it in the operating numbers, some counted it as a special, non-operating item. i think UAL reported it as a "special item" on it's public books, but I'm not aware of the position they took WRT the DIP books.
UAL will have an operating PROFIT for the 3rd Q (likely in excess of 150 million), despite not yet achieve ALL of the cost reductions it will achieve in BK (as opposed to other airline actually losing money in Q3 despite having achieved all BK cuts...and now intimating they need additional cuts...)
Whether or not someone meets or violates DIP requirements, is not, IMHO, "splitting hairs"
