USAPA routine run on the PHX Island after dwellers refuse to negotiate the Nic.
Huh, negotiate, geez we offered them the NIC, they turned the NIC down.

Dave Blomgren .........U-turn

Hey flounder is Dave. Liar?..................well we're waiting .......

"Yes, the East offered the NIC. They just wanted to protect their retirement attrition, which stalled by the change in Age-60. Looking back, that offer must look like a home run to any West pilot right now!"

Dave you really screwed your pilot group over, they hate you!...........big smiles boy

You are so "desperate"..................you should quit and find another job.

Tough guy actor Chris Bauer has been cast as US Airline Pilots Association Safety Chair Larry Rooney.  The macho Bauer is a perfect choice for this role as the bulldog advocate and protector of the 1549 crew.

Hardly a fair comparison sir. Mr. Deezen's at least a somewhat accomplished and at least professional comic, while Gay, even though providing us all dependably repeated laughs via Crew News, etc, can only be considered at best an amateur....At least so far. Perhaps there's more and even better yet to come that could leave a whole room uncontrollably laughing on the floor? ;)

In full fariness though; I honestly do feel a bit sorry for the poor fellow.

Ya' know what?...We really should just leave the little "spartan" kids alone to "do their thing" anyway. It must be long-past the time when the water in the PHX's self-described "Fishbowl" needed changing, and that water must nowadays be pretty close to toxic....

You should be more worried about how the USAPA Merger Comm....er....I mean the East Pilot Seniority Committee is going to argue.....

Never mind. I forgot that you're "supremely confident". I'm sure you'll get everything that you are entitled to.

“…The Arbitration Board conducts an evidentiary hearing, with witnesses, evidence and a stenographic transcript. The Board’s Opinion and Award are to be issued simultaneously, within 150 days following the PID, unless both pilot groups and ALPA’s President agree to an extension. The Merger Policy provides, “The Award of the Arbitration Board shall be final and binding on all parties to the arbitration and shall be defended by ALPA.” No ALPA seniority integration arbitration result has ever been set aside by the courts although some dissatisfied pilots have challenged the award before administrative agencies and the courts.”

Even Mike Cleary gets it....WYE can't you, Johnny Boy?  I'm a little worried about a melt-down from you next Spring.  You gonna be OK, Buddy?

“In this instance, despite a year of negotiating efforts, there was no agreement on a list. Subsequently, the Representatives choose the Undersigned as Board Chairman and opted for the Med-Arb process. Those mediation efforts, held over the course of five days in October 2006, were similarly unsuccessful. Thereafter, the Parties agreed on the arbitration ground rules, and, pursuant to the Policy, each chose a Pilot Neutral from ALPA's Pilot Neutral Master List as a nonvoting member of the Arbitration Board.

The Board shall retain jurisdiction in accordance with Section H. 5 .b. of the ALPA Merger Policy to resolve any disputes over the meaning or interpretation of this Award. This retention of jurisdiction shall terminate when all provisions of the Award have been satisfied. In the event the Chairman becomes unavailable or unwilling to serve to resolve such disputes, the Merger Committees will agree on a replacement Chairman or will select one by the alternate strike method from the most recent ALPA list of seniority integrations arbitrators.  In the event one of the Pilot Neutrals becomes unable or unwilling to serve on the Arbitration Board to resolve such disputes, the Chairman, after consultation with the Parties, shall decide how to proceed.  In any such arbitration, if there is a dispute between the methodology contained in the Award and the accompanying Integrated Seniority List or any other list purportedly using such methodology, the Seniority List prevails.

“Of course, in negotiating for a particular seniority regime, USAPA must not breach its duty of fair representation. Accordingly, if USAPA wishes to abandon the Nicolau Award and accept the consequences of this course of action, it is free to do so.  By discarding the result of a valid arbitration and negotiating for a different seniority regime, USAPA is running the risk that it will be sued by the disadvantaged pilots when the new collective bargaining agreement is finalized. An impartial arbitrator’s decision regarding an appropriate method of seniority integration is powerful evidence of a fair result. Discarding the Nicolau Award places USAPA on dangerous ground.

Judge Silver gets it, and jet Johnny Boy just can't wrap his mind around these simple legal concepts.
