Check out Tony Anger on Facebook. This is one very strange person!
Eric Auxier narrates. Another whack job.
In 2045 the West will be donating to Marty's kid (the next lawyer of the family) to pay for Marty's grandkid's lawschool (the next, next lawyer in the family).

P.S. That video next to the fireplace, in 2045, is obviously being hosted at Marty's house (the guest house). After all the donations, it is highly unlikely a West pilot will be able to afford a house with a fire place (if they even can now).

What else could anyone honestly expect from some purely self-styled "army" of supposed "spartan soldiers"/"battle"-tested-"knights" and even "dire wolves"?  Even in that last-posted and utterly infantile video we apparently have, and I quote: "A surviving"..umm..."veteran' west pilot that 'fought' with the army of leonidas"...in some Fantasyland "war". More perfectly demonstrated examples of Arrested Development would be difficult to find anywhere. What completely disgusting disgraces to the aviation community and our Nation's real-life Soldiers...Disgusting disgraces being my best efforts at sugar-coating things a bit here.

Perhaps all "sparta's" hopelessly infantile little "soldiers" and of course heroic "veterans" of "war" should at least look at the following prior to commencing any further exercises in thumb-sucking:

Hmmmm. Blathering about a 8+ year old video and your assessment of the actor's personality multiple times. Not desperate at all boys.

I forcast a great deal of East wailing & gnashing of teeth this next Spring. Maybe we can produce a video that will help to soothe you.

You should produce the video now because you won't have time when the SLI comes out. 1,700 pilots will all be rushing to LAX for their 777 seats. You gotta plan ahead. Real estate will go through the roof.

No matter really. Your passive-aggressive, childish wimp factor's already well established. The rest is in the hands of arbitrators that you've not the slightest control over, nor any better notions than everyone else as to how they will decide things...and some "vacation" you must be having to yet obsess over this thread's nonsense. I must honestly feel sorry for you now.

Eight years ago things were in the hands of arbitrator Nicolau that "you've not the slightest control over, nor any better notions than everyone else as to how he would decide things."  Yet how did you and the army of eastholes respond?  I must honestly feel disgust for you now.

You guys love to tell us how we have to accept the decisions of the BOA yet consider yourselves exempt from doing the same.

It is all about the binding terms of a contract or the contingencies in a contract.

It's just the way it is. Contengencies are every bit as contractual as any other stipulation.

Assumptions notwithstanding.

“….The Court’s patience with USAPA has run out.  USAPA avoided liability on the DFR claim by the slimmest of margins and the Court has serious doubts that USAPA will fairly and adequately represent all of its members while it remains a certified representative.  But all the Court can do at this stage is implore USAPA to, in the words of CAB, “make every effort to see that [the West Pilots’] are given extensive consideration, and that their interests are fairly and fully represented” during seniority integration…”

Case 2:13-cv-00471-ROS   Document 298   Filed 01/10/14

The Ninth Circuit’s holding, that the denial of the Nicolau Award in Paragraph 10.h. of the MOU breached USAPA’s duty of fair representation, is effectively the tie-breaker on this question.  With the Ninth Circuit’s affirmation of the West Pilots’ reasonable expectation of the Nicolau Award, the AASPIC acknowledges it as the starting point for ranking the East and West Pilots on the ISL. As part of the ISL, the US Airways Pilots (East and West) should be ordered based on the Nicola Award……the job allocations as between the West and East Pilots must be rationalized according to the Nicolau Award as those pilots compete for jobs with each other for the first time, so that West Pilots achieve their expectations vis a vis the East Pilots.
AAPSIC Pre-Hearing Statement                                                                                               19 Sept 2015

“…The Arbitration Board conducts an evidentiary hearing, with witnesses, evidence and a stenographic transcript. The Board’s Opinion and Award are to be issued simultaneously, within 150 days following the PID, unless both pilot groups and ALPA’s President agree to an extension. The Merger Policy provides, “The Award of the Arbitration Board shall be final and binding on all parties to the arbitration and shall be defended by ALPA.” No ALPA seniority integration arbitration result has ever been set aside by the courts although some dissatisfied pilots have challenged the award before administrative agencies and the courts.”

Blah, blah,blah.............Wye River, ask Russ
He is still researching ancient, irrelevant court documents as if his side is still in a legal battle. The courts are shut out. The courts could never change any contract or force all sides past the contingencies that belonged to the pilots themselves.

The courts were never in a position to do jack, and they never will be... The courts never had any jurisdiction about how to use (or if to use) the Nic. They only had jurisdiction over the enforcement of the contracts, as written (not the contracts the west and Buyme wished had been written). By now you would think the west could learn the rules of the game.

The fine print is kicking their arse.

Don't cry Johnny Boy, it's going work out just fine.
Yes it is, very fine, outside the fishbowl that is.

Poor kid just does not seem to get it, meltdown coming.

"USAPAs abandonment of the Nicolau Award was permissible, i.e. supported by a legitimate union purpose. Thus, the best declaratory judgment the Court can offer is that USAPAs seniority proposal does not automatically breach its duty of fair representation.3"

"IT IS FURTHER ORDERED the Clerk of Court shall enter judgment dismissing Counts I and III of the complaint and in favor of US Airline Pilots Association on Count II of the complaint stating US Airline Pilots Associations seniority proposal does not breach its duty of fair representation provided it is supported by a legitimate union purpose."

DATED this 11th day of October, 2012.

Roslyn O. Silver

Senior United States District Judge

"If the ALPA process was final and binding why was there a Rice committee, a blue ribbon panel and Wye River? But then, our own Merger attorney made it clear in a court filing back in July 2007 that the proposed pilot seniority list developed through ALPAs Merger policy that ALPA will adopt as its bargaining position to be presented to the Company, but which (like a union bargaining position in any matter) the Company is not required to accept.
