The refinery operations are under a separate leader than DL had when they bought the refinery. It is entirely possible that the new leader is willing to join with other entities in the refining industry in pushing for legal change.
It's possible that the former leadership intended to deal with the problem but didn't have the chance to do so.
Either way, the chances that DL was caught off guard on the issue are pretty small.
