Specifically, the LPP terms provide:

Section 2(a). The term "merger" as used herein means
joint action by the two carriers whereby they unify,
consolidate, merge, or pool in whole or in part their
separate airline facilities or any of the operations or
services previously performed by them through such
separate facilities.

* * *

Section 3. Insofar as the merger affects the seniority
rights of the carriers' employees, provisions shall be

5

made for the integration of seniority lists in a fair and
equitable manner, including, where applicable,
agreement through collective bargaining between the
carriers and the representative of the employees
affected. In the event of failure to agree, the dispute
may be submitted by either party for adjustment in
accordance with section 13.

Section 13(a). In the event that any dispute or
controversy . . . arises with respect to the protections
provided herein, which cannot be settled by the parties
within 20 days after the controversy arises, it may be
referred by any party to an arbitrator selected from a
panel of seven names furnished by the National
Mediation Board for consideration and determination.

(Labor Protective Provisions, sections 2(a), 3, and 13(a)).2

Are you reading this US? The outcome will be the same no matter which union is represented. So why not go with the union that offers more?

At least with HP if someone wants to come to Phoenix they have to wait for an opening no matter what their senority is. I hear all you have to do at US is say you want to go to a different station and if you hold more senority then you bump the lowest person out of that station. That is fair? Nice union.

Dont get paid for sick days? Need to be sick 5 days to get half pay? Nice union.

Pay cut right off the bat? Nice union.

Teamsters would never sell out their people like IAM did. Who would even suggest stupid ideas like that?

Think about the bigger picture. Not just this moment. Your senority is in the same hands no matter what union is picked. Choose the one that protects its people. And is better than the one that you are stuck in til 2010. We are almost done negotiating ours. Way better than yours. Our old one is better than your bankruptcy one.

You old farts will be the first ones that complain about the IAM contract later.

We cannot bump into a station. We also have to wait for an opening or if furloughed we have to go where the most junior agent works.

Don't let the arbitration tested scope langauge get in the way of one of your rants.

Plain and simple you are not correct.

Why don't you take the time to comprehend the facts?

Time will tell.....

Time has all ready told, but I guess you can't fathom that since you are no longer with US.

Not officially out of BK yet, maybe that contract will still be rejected a.k.a. Pit leases at the last minute!!! Air Canada did not give merged companies the $$$ cause they were nice guys.....they want the maintenance!!!!!! I have no faith in ANY scope or contract in this day and age

Labor contract rejections do not work like that, you have to follow section 1113 C which forces both parties to negotiate for 30 days. Also US has all ready affirmed the contract.

Collective bargaining agreement remains in effect, and the collective bargaining process continues, after the filing of a bankruptcy petition “unless and untilâ€￾ the company complies with the provisions of Section 1113. Accordingly, before the court may authorize the rejection of a collective bargaining agreement the company must prove to the court that the following nine (9) requirements have been met:

1. The company must have made a proposal to the union.

2. The proposal must be based upon the most complete and reliable information available at the time of the proposal.

3. The modifications must be necessary to permit reorganization.

4. The modifications must provide that all affected parties are treated fairly and equitably.

5. The company must provide the union with such relevant information as is necessary to evaluate the proposal.

6. The company must have met with the collective bargaining representative at reasonable times subsequent to making the proposal.

7. The debtor must have negotiated with the union concerning the proposal in good faith.

8. The union must have refused to accept the proposal without good cause.

9. The balance of the equities must clearly favor rejection of the agreement.

If the court agrees that the company has met these conditions, it may reject the collective bargaining agreement.
