ALPA Executive Council Passes Four new resolutions concerning US Air/America West

In a series of votes, ALPA’s Executive Council today passed four resolutions that address issues raised in the ongoing merger of US Airways and America West.

The resolutions settled four outstanding issues:

1) The Council made a firm commitment to support a fast-track negotiating strategy to raise the pay of AAA pilots in order to achieve pay parity with AWA pilots and to achieve major raises (pay parity plus) for both pilot groups. These negotiations—which will move AAA and AWA pay rates beyond current AWA levels—will be conducted by the Joint Negotiating Committee (JNC). Specific terms for timing and retroactive payment will be negotiated by the JNC.

2) The Council found that there was no basis to set aside the seniority arbitration award issued in May by an arbitration board. The Council concluded that no evidence of impropriety or failure to follow ALPA Merger Policy had been presented. ALPA will now defend the award. The award is to be submitted to management as issued, but with the proviso that it will have no effect until the parties complete a single collective bargaining agreement.

3) The Council confirmed that the $2 million previously approved from the Major Contingency Fund to support AAA and AWA pilot groups is for strike preparedness, communications, and family awareness activities directly attributable to joint negotiations. Upon resumption by the AAA MEC of participation in joint negotiations, the MEC can submit a communications plan and MCF budget that will allow it access to the funds.

4) The Council determined that there was no basis under the ALPA–US Airways Transition Agreement to contest the operation of US Airways under a single FAA operating certificate with separate operations that keep the aircraft and pilots of AAA and AWA apart until completion of a single collective bargaining agreement.

These actions came after months of presentations, debate, legal analysis, and communications with the MECs and line pilots. The focus will now turn to the next round of joint negotiations to achieve an improved CBA for all pilots at US Airways.

The drive is complete and news will be coming shortly on that front. It will most certainly mean that there will be no single contract until this is resolved in a way acceptable to the East pilots, most likely in the form of a USAPA negotiated contract with all bidding in section 22 predicated of DOH.

There is a reason that no one involved including the AWA MEC has indicated there is a breach of the TA. If so, the agreement with the company would be null and would revert back to the respective contracts.

This would mean an end to the profit sharing, the 10% DC plan contribution, and the minimum fleet protection guarantee that reside for the AWA pilots in the TA, but not part of their contract. These items and protection exist in the EAST contract as bad as it is, separate from the TA. There is no successor ship language in the AWA scope section, while there is in the EAST contract and there is legal validity to the AWA pilot being placed under LOA 93 which predicates seniority based on DOH.

This is far from over and likely will be a bloody battle with ALPA playing school yard bully and getting down in the mud, but nothing new there and it should be no surprise to anyone. This is what ALPA wanted and as this plays out over the next several years the rest of the profession will suffer for ALPA's failures.

I don't know but maybe in five years when the CBA becomes amendable again, the apostles from the "church of the higher union" can swear damnation on us all, pontificate about a second coming of the anti-Nic spirit, and then hold a pot luck to collect a few dollars.

Pohn Jrater has already said that the East WILL be represented at the Joint Negotiations. Fully expect him to cram down a joint contract in the same way ALPA stole the pension from USAir pilots.

P.J.s best hope is for Parker to split the company up and disperse the USAPA supporters in a quick sale before a free and fair election of bargaining agents can occur.

After all, the ALPA leaders wear wings made from pieces of silver.
 
Dude....it's over. Really, it is.

I'm not going quite that far, but this is going to make it harder in the long run for East even if USAPA is voted in. The court's will eventually be looking to this decision even if East never signs the joint agreement.
