They cant have it both way.  I understand their frustration but they need to embrace it and get behind the idea.  Marriage is between two people (currently) and it does not matter what to people as long as they consent.

From a practical matter, that's really only required by the Catholic Church.

From a legal standpoint, a few states in the US still have consummation on the books as a requirement for a marriage to be held as valid; in practice, the only time it probably ever comes up as an issue is when dissolving the marriage, since consummation (or lack therefore of) is one of the limited grounds which can trigger an annulment vs. a divorce.
 
Wait. Back up a second. There were actually laws on the books regarding consuming a marriage? I'm going to have to look that crap up when I have time later.

Yep. There were, and still are. Not sure how current the list below is, but as you can see, they're mostly in the Southern States where the Tea Party controls things:

AS, CO, CT, DE, ID, IL, MI, MN, MT, OH, SC, VT, WI

There are other states who list consummation as grounds for an annulment, but they don't explicitly require it for the marriage to be considered valid.
