Judge Rules Democratic Secretary of State Broke Law With Ballot Order , Vindicating Trump Claim
A Michigan judge ruled last week Secretary of State Jocelyn Benson (D) broke state law when she unilaterally issued rules related to absentee balloting, legitimizing a key claim made by the Trump campaign in its legal challenges to the 2020 election.
Benson issued several unilateral orders during the 2020 election including sending absentee ballot applications to all registered voters. She also issued “guidance” on how to evaluate absentee ballots, a move Michigan Court of Claims Chief Judge Christopher Murray held violated the state’s Administrative Procedures Act.

“I’m glad the court sees Secretary of State Benson’s attempts at lawmaking for what they are — clear violations of her authority,” Michigan state Rep. Matt Hall (R) said in a statement.
The court’s opinion concluded:
…nowhere in this state’s election law has the Legislature indicated that signatures are to be presumed valid, nor did the Legislature require that signatures are to be accepted so long as there are any redeeming qualities in the application or return envelope as compared with the signature on file. Policy determinations like the one at issue — which places the thumb on the scale in favor of a signature’s validity — should be made pursuant to properly promulgated rules under the APA or by the Legislature.

Hall noted, “The Legislature is an equal branch of government charged with crafting laws. This is not the role of the Secretary of State, and there is a clear process that must be respected.”
Signature validation rules created without the approval of a legislature was one of the issues the Trump campaign and Republicans claimed was done illegally in the 2020 election.

This is basically what that lawsuit that started in Texas was all about. It wasn't about overturning the election, it was about getting the SCOTUS nod that the five or so states that joined in the suit all had secretaries of state that implemented 'law' outside of their purview and their actions were unconstitutional.

A Georgia judge might unseal absentee ballots in Fulton County so that a government watchdog can investigate allegations of voting fraud from the 2020 presidential election. An overwhelming majority of Atlanta lies within Fulton County.
A lawsuit filed in the Fulton County Superior Court alleges that fraudulent ballots were cast and other irregularities occurred as workers counted ballots at State Farm Arena on Election Night, The Atlanta Journal-Constitution reported Monday. Ultimately, those claims were investigated and rebuked by the secretary of state’s office. Although, the judge overseeing the case—Henry County Superior Court Judge Brian Amero—said he’s willing to order the ballots to be unsealed and examined by experts who Garland Favorito, a voting-integrity advocate, hired.

The observers were suspicious of ballots that were printed on a different stock of paper than regular ballots, appeared to have been printed instead of marked by ink in a voter’s hand or were not creased, indicating they had not been placed in an absentee ballot envelope and mailed.

“As elected officials, we have the duty to do the right thing, and mail-in voting is not one of them, I’m glad the courts are enforcing the laws of the constitution. This is not the time to experiment with mail-in voting. Voting in person gives more confidence to the voters that the election will be a fair process,” Tobey noted.
“The election can be held safely, Tobey said, by following Centers for Disease Control and Prevention guidelines,” the outlet adds.

Between his two major companies, Amazon and the Washington Post, Jeff Bezos does not hold consistent views on mail-in voting. When it could assist his preferred presidential candidate in reaching the White House, it was safe, and any questions to the contrary were mere attempts to undermine democracy. Yet now that his own employees at Amazon wish to use those same methods to vote for unionization, suddenly this wonderful format is not secure enough.
