A giant face palm on that one. Hear a lot of people saying whoever did it probably pulled the CVR breaker.  Unless they had access to the forward E/E the answer to that is no.  Not that it really matters,
 
Well where it is might be questionable, but the fact that it is intact and that the pilot is alive somewhere are perhaps a reality. From the article:

Investigators have previously refused to “clear” the captain’s flight simulator of suspicious activity, and it now appears they found evidence of routes programmed to take a plane far out into the Indian Ocean and practising landing using a short runway on an island.

A short runway on an island proves this was a deliberate skyjacking. If he wanted to commit murder-suicide he would have taken off and crashed somewhere even in the ocean. The fact that his simulator had this program means, like I already said, NORAD should be on high alert!
