Nice sound bite but when a company knowing build a faulty product (Ford Pinto ring any bells) and said product kills several people the company who built the product with total disregard for human life should be force to pay through the nose. According to internal documents that came out during trial, they figured it would be cheaper to pay a few law suits than to fix the problem. I think in a case such as that, they should be fined 10% of their net worth. THAT will make them think twice about screwing over the public.

Military tribunals – I thought we had a constitution. Seems a bit underhanded to me. You know, not seeing a lawyer, not knowing what the evidence is, not being charged with anything…

A Presidential Executive Order, whether Constitutional or not, becomes law simply by its publication in the Federal Registry. Congress is by-passed. Here are just a few Executive Orders that would suspend the Constitution and the Bill of Rights. These Executive Orders have been on record for nearly 30 years and could be enacted by the stroke of a Presidential pen:


EXECUTIVE ORDER 10990 allows the government to take over all modes of transportation and control of highways and seaports.

EXECUTIVE ORDER 10995 allows the government to seize and control the communication media.

EXECUTIVE ORDER 10997 allows the government to take over all electrical power, gas, petroleum, fuels and minerals.

EXECUTIVE ORDER 10998 allows the government to take over all food resources and farms.

EXECUTIVE ORDER 11000 allows the government to mobilize civilians into work brigades under government supervision.

EXECUTIVE ORDER 11001 allows the government to take over all health, education and welfare functions.

EXECUTIVE ORDER 11002 designates the Postmaster General to operate a national registration of all persons.

EXECUTIVE ORDER 11003 allows the government to take over all airports and aircraft, including commercial aircraft.

EXECUTIVE ORDER 11004 allows the Housing and Finance Authority to relocate communities, build new housing with public funds, designate areas to be abandoned, and establish new locations for populations.

EXECUTIVE ORDER 11005 allows the government to take over railroads, inland waterways and public storage facilities.

EXECUTIVE ORDER 11051 specifies the responsibility of the Office of Emergency Planning and gives authorization to put all Executive Orders into effect in times of increased international tensions and economic or financial crisis.

EXECUTIVE ORDER 11310 grants authority to the Department of Justice to enforce the plans set out in Executive Orders, to institute industrial support, to establish judicial and legislative liaison, to control all aliens, to operate penal and correctional institutions, and to advise and assist the President.

Without Congressional approval, the President now has the power to transfer whole populations to any part of the country, the power to suspend the Press and to force a national registration of all persons. The President, in essence, has dictatorial powers never provided to him under the Constitution. The President has the power to suspend the Constitution and the Bill of Rights in a real or perceived emergency. Unlike Lincoln and Roosevelt, these powers are not derived from a wartime need, but from any crisis, domestic or foreign, hostile or economic. Roosevelt created extraordinary measures during the Great Depression, but any President faced with a similar, or lesser, economic crisis now has extraordinary powers to assume dictatorial status.

Here is an example of an individual who hates this country but will quickly say he only hates it's leadership.

This is the epitome of how twisted a liberal thinks and why they are a real danger to our once great country.

With the libs back in control the restraining force that held back full blown evil has been overcome.

This is nothing new. President Truman tried a similar stunt during the Korean War. Truman refused to impose price controls in the Steel Industry. The Steel Workers Union was about to strike because they wanted higher wages. Instead of letting them have their labor dispute, Truman attempted to take-over and seize these private businesses. Of course, Truman cited 'National Emergency Provisions’ as the reasons for his actions.

Obviously, the Supreme Court wasn't having any of that. Since that case, the Presidential powers have been limited in regards to seizing private property during "national crises".

Moral of the story: The President can sign any Executive Order; but it still needs to pass constitutional muster.

One thing that is a bit scary though: The standards used by the Supreme Court are different during extreme national emergencies. For example, a few months after 9/11, President Bush signed an Executive Order that overhauled SAM orders for prisoners and their lawyers in the United States. Now, the government can wiretap the attorney of the suspected criminal and listen to their conversation... even conversation that is protected by the attorney/client privilege. The gov't doesn't need probable cause; the gov't doesn't need approval by a court before they spy. All they need is a reasonable suspicion... but apparently, the gov't will wiretap the attorneys just to 'find out' if there is reasonable suspicion. In their words... "they are already SUSPECTED of a crime." This has yet to go before the Supreme Court, but they will not touch it yet because of its relation to 9/11.

I was asking you about how the government will stop terrorism by impeding my rights because I really want to know your opinion? I often sway back and forth on this issue because my rights are important to me; but I also would like to see our country safe from terrorism.

In a perfect world, the gov't could prevent terrorism without stomping on our rights. However, we are all aware that is an unlikely event.

You cited several examples in which the gov't spies on us. I, however, do not care as much about our so-called 'right to privacy'. That is not a "true" right as it is not mentioned in the Constitution... it is only a right that our supreme court read into the constitution. As easily as it can be read into the constitution, it can be read out of the constitution. We will see if that right will be limited or completely done away with now that the makeup of the court is different. Don't get me wrong; I cherish my privacy, but it is the least of my concerns at this point.

I am more concerned about due process, freedom of speech, etc. Abu Ghraib prison is a concern of mine; not so much because I care for the souls inside the prison, but because I am concerned that type of scenario could be forced against U.S. citizens (like it was against U.S. citizens of Japanese heritage during World War 2).

Furthermore, we all know by now that our rights are not absolute, but rather, are limited in many regards.

I suppose, in my opinion as it currently stands, I would be OK with the gov't impeding my so-called right of privacy; but I would be very nervous if the gov't was severely impeding my right to due process and freedom of speech.
