The defense would have to prove the claims that were made in the book. They already admitted they have no proof via internal emails between the publisher and the author.

FOX news already testified in a court proceeding along with several other news conglomerates that they are not required to report the truth or to be truthful. The standard for slander or defamation is quite a bit higher for a public figure than it is for a private citizen. Look at all the lies the tabloids publish and they have only been sued successfully a hand full of times compared to that amount of lies they publish. I agree that she will not not press the issue but not because of dirt in her closet (although they may be some) but because it is an uphill battle that typically is not worth it.

Nice speech but not really relevant. All I was discussing was the standards for slander or defamation. They are higher/different for a public person than they are for a private person. It is very difficult (but not impossible) for a public persona to win such a case.

Welll the rumors of her Husband filing for divorce are starting to fly around rather nicely. Thing is for right now it's all just that rumor, speculation and the like.

Author McGuiness is a very suspect individual ethically and has been sued several times. Once successfully in the McDonald Case. The book BTW is a crackling great read, it's sad the author is so flawed ethically.

In this case perhaps the author and subject are made for each other in terms of flawed personalities?
