Food for thought:

"It is starting to look like the MDA pilots may win with their duty of fair representation suit against ALPA. ALPA has acknowledged mistakes in the treatment of the MDA pilot group and offered a settlement of 1million.

The MDA pilots refused. If the judgment comes in against ALPA then the law suit against the Nicolau award has some merit. That is to say if a court finds ALPA guilty of error under the duty of fair representation statute and the MDA pilots were not included [properly] in the award, then the award might be overturned."

Alright AFA b*tches wheres MY money? Actually, just give me my two years of back pay and more importantly put me back at my rightful pay scale equal to my years of active service. And one more request, represent us instead of sacrificing some members for the benefit of others. Not too much to ask!

This could be big.

If US east, which, of course, would include MDA, shucked ALPA, AWA could be sucking hind tutu on this.

Can we go after Tosi, who "fathered" this " MDA plan"? After Libby, I would love to see Tosi in jail, love to see him kicked out of his 1.7 million house on the water in FL and frog-walked from his $170,000 a year "mediator" job given him courtesy Jerry Glass.

As an ALPA rep he was never "for" a pilot, unless it enhanced his "position".

Is there a source for the OP?

Source?

320 is the only reliable source.. so I guess it isn't true.

The most interesting part is that there were many furloughed pilots that were SENIOR to the "MDA" pilots because they passed on the Mainline crap job opportunity. So if Nicolau had properly acknowledged that the most junior Mainline pilot not on furlough...

MDA was a scam by ALPA to get the pilots to feel good about taking paycuts and furloughs in exchange for getting more Rat Jets (that would pay 70-80K for the FOs.. NOT.

They welcomed the MDA pilots as Mainline pilots on the one hand and treated them like single pilot overnight freight dogs. Now they want to cough up a mill to make it go away.

I have a better idea. Make Tosi give up his 1.7 Mill house for the MDA pilots to use as a commuter crash pad.

TOSI LIES!!!!!!!!

1 million! El Cheap'o. Good for them for refusing. Theres like 250 pilots in the lawsuit. HMMM..4000 apeice...haha. They should get 1 million each.
This whole lawsuit is in the bag..both f/a's and pilots. Its all been admitted and all the evidence is clearly on point. It will all be soon over. Just sit tight and let it all happen. All MDA flight crews will be happy.

As a total outsider/layman. This sounds like a process problem to me.

Yes. It would represent a huge corruption of the Merger process.

Nicolau judged that MDA pilots were not "active pilots" on the seniority list at USAir, and Nicolau's reasoning stapled them based on the judgment he made respecting their status.

If the courts judge that:

1. MDA pilots were in fact Active Pilots on the USAir seniority list,
2. in contradiction to Nicolau,
3. as ALPA previously acknowledged (even boasted about), but wish they hadn't,

then there is by definition, a huge corruption of the Nicolau list. (Even if it is decided that Nicolau's reasoning was proper, his list is corrupted because he had in inaccurate list.)

It would not just be the 250 or so pilots at MDA that would be unjustly treated by the Nicolau award, it would also be all the pilots senior to them that were on voluntary furlough because they passed on the opportunity to work at mainine MDA.

ALPA understandably now wants to toss a million dollars at the MDA pilots to get them to shut up and agree that they were not Active pilots at USAir, in order to protect the Nicolau list from being placed in jeopardy.

And MDA pilots of course won't settle with ALPA because it is in their interest to have the judge declare ALPA at fault for failing to defend their status as Mainline employees.

Thus, ALPO...Listen carefully. Pound sand. 😛

The MDA issue is not going to go away, and they need to settle it before there are any merged pilot or F/A lists with anybody. The company, AFA, and ALPA need to just cough up and admit thier fault, make it right for those few hundred people, and let everyone move on. You can't just throw money at it. Admit these people worked here, and treat them accordingly for seniority and longevity purposes.

Its not going away, and throwing money at it wont make it. All or None!

Just found this:

"ALPA National denies any claim that it has proffered a settlement in the case brought by the pilots of MDA. ALPA National believes the case has no merit and finds the DFR lawsuit absurd."

This is what they will be saying about the AWA DFR lawsuit soon.
