One of the Captains I flew with a while ago had a practice in Orange County. I know of one FO who is independently wealthy and chooses to work. I was elated to be hired, I graduated Dean's list and had thousands of hours of 121 PIC. Totally shocking I know, I thought AWA was just a commuter airline. 🙂

Perhaps Captain Gay will exit his Nic4 us persona and speak clear and directly about the issues.

I don't laugh at how he speaks, but I do laugh as he flounders around, trying to make a point. He always try's to make a link to the reason that the company should use the NIC... Don't think he will like the outcome.

The biggest change I see in all of that is the joint contract occurs prior to the seniority integration to put an end to the lowlife separate ops, destructive path the east's scab union has caused within the industry.

That is because you must be blind or ignorant. So the change to three arbitrators is not a big change? Did you miss the part about longevity too?

A lot came out of the plan of reorganization that American Airlines released to the bankruptcy court this week, but among the filing was this little note that the merger of American Airlines and US Airways will cost about $1.2 billion.

Judge Silver will dismiss. The case is not ripe. Nothing is different in front of her. Nothing has ACTUALLY changed. There is a new MOU, but it is conditional on the merger happening.

As to the MOU, the case law supports USAPA. Since the West Class ratified it, there is legal precedent that prevents them from suing with a DFR.

And besides all that....they make ZERO case in their DFR claim. They do not even address the standards required to frame a DFR.

It’s over. Judge Silver will dismiss. The POR will come and go. And in their filing to the Ninth, the Company agrees....we all move on to a new process.

Read the USAPA motion to dismiss. It’s all there, and it has real case law in it, not nebulous Harper mumbo jumbo recycled Wake arguments (which WILL be thrown out by Silver....the law says that even never happened. Even Judge Wake said it never happened.)

What do you think of AMR's request for the bankruptcy judge to tell Silver about ripeness in her court?

AMR asks the bankruptcy judge to take action to prevent proceedings in the Arizona Action from interfering with the bankruptcy proceedings.... yet, I am not aware of anything USAPA is seeking at the AZ action, and AMR certainly lists nothing that USAPA is doing to impede the merger... but not so much for the West class...

West counsel meant to "communicate a far less comprehensive commitment than was understood by the other entities involved when he stated at the status conference that the West Pilots had “absolutely no intent to do anything that might interfere with the merger"

Instead, the West counsel made it clear they had no intention of promising that "they would refrain from
taking actions that could delay or otherwise interfere with the processes that form part of the
merger or that would undermine the merging entities’ ability to fulfill the numerous contractual
obligations they have undertaken that are designed to facilitate the merger process. (Of first note, the contractual obligations are contingent obligations. And the West Class was not a party to those contractual obligations--other than as represented by USAPA--and if they happen to disagree with USAPA, the West Class is bound and unable to prevent USAPA from bargaining on behalf of all USAirways pilots.)
