USAPA update for East pilots:
Today we withdrew our action in the Bankruptcy Court of the Southern District of New York.
As background, on February 19, Marty Harper, the attorney representing certain West Pilots, wrote to USAPA’s merger counsel threatening to enjoin the merger unless the seniority list advocated by certain West pilots was advanced during the ensuing seniority integration proceedings with APA: "…the West Pilots will be forced to file a third round of litigation and seek an injunction of the merger process…"

USAPA could not allow such a threat to go unanswered and instructed its attorneys to file an action in the Bankruptcy Court in New York to stop Leonidas and certain West Pilots from interfering with the merger. On April 22, Leonidas wrote to its members and, in a reversal from Mr. Harper's position of February 19, stated: “Nobody on the West wants to stop the merger." As a result of that statement, we believe that we have been successful in stopping the threat and can go forward in the defense of our members' rights, without the threat of certain West pilots to deprive all of our pilots the benefits of the merger. If, however, we find that the merger is any way threatened again, we will take whatever legal action necessary to preserve the benefits of the merger for all of our members.
Additionally, in reaction to the February 19 letter, our attorneys are tasked with defending an action in the Phoenix courts for the third time. In the previous two cases, the attempts by certain West pilots to defeat USAPA's constitutionally mandated position have been rejected by the Courts. We expect no less in the case presently pending in Phoenix. Nevertheless, our attorneys have advised us that it would be best if we concentrated our efforts in rebuffing the thrice brought action in Phoenix, especially since we have essentially accomplished what we set out to do in the Southern District of New York.
Despite these attempts to distract, we will continue to focus our attention on protecting the rights of
all our pilots as we move forward in the seniority integration process.
