Regardless of whether this nominee or another Republican President's nominee is appointed to the Supreme Court, this NY TIMES op-ed is threatening the Court with a "political solution" to its alleged "manifestly ideological agenda."
The author suggests that the Court is overreaching and it should be corrected by increasing or decreasing its membership. This tactic has been used by Congress in years passed, but we havn't seen it used in the past 150 years.
I would love to see Congress' ratings go to an all-time low after they try such a maneuver.
The author closes the article by saying: "If the current five-man majority persists in thumbing its nose at popular values, the election of a Democratic president and Congress could provide a corrective. It requires only a majority vote in both houses to add a justice or two. Chief Justice John Roberts and his conservative colleagues might do well to bear in mind that the roll call of presidents who have used this option includes not just Roosevelt but also Adams, Jefferson, Jackson, Lincoln and Grant."
