"US Airways says"...you got that one wrong...LCC says and testified as much in federal court, that the only accepted system seniority list at LCC is the Nic, and that they consider it "status quo" as per the RLA.

Then according to your contract it is the obligation of the Company to publish the combined list, the one you say we got from LOA 96. I suggest you ask them to publish it. If they won't, I suggest you file a grievance. I wonder what their answer will be? RR

Leonidas Update

As we predicted, earlier today, Judges Tashima, Ikuna and Smith of the Ninth Circuit Court of Appeals issued an order denying USAPA’s Writ of Mandamus petition, as well as USAPA’s Motion to Stay the trial before Judge Silver, stating that USAPA “has not demonstrated that this cases warrants the intervention of this court by means of the extraordinary remedy of mandamus.” You can read the order here:

With today’s order from the Ninth, there is nothing standing in between USAPA and DFR trial number two.

What makes the Nic STAND as our current list is the fact that there are ratified contracts in LOA93, contract 2004 and the TA that all say Nic is the staus quo at LCC.

Uscaba inherited all the contracts and the Nic.

Again, why did LCC management volley your request for a company published Nic list back?
And at warp speed? They refuse to publish and hand you a list with seniority ordered per the Nicolau. How is that "accepted?"

I have read the NMB report. Just because some NMB intern gets the facts wrong some 3 years after the fact in the course of certifying a SCAB union, does not change the fact that AWA acquired AAA.

Let's take a look at some documents at the time of the merger. The SEC, the company annual report, the AP wire, Bloomberg, CNN, all local papers in PHX..PHL..PIT..CLT all reporting America West BUYS US Airways.

PS. The Nic is still the only accepted system seniority list covering all LCC pilots. You do know who LCC is right? Just in case you forgot, LCC is the corporation formed when America West BOUGHt the bankrupt, about to go CH7 , #### hole of an airline you worked.

No, not according to me or my contract. I did not file that grievance.

Instead, I sued in federal court, and guess what, the company asked to be let back in after being dismissed.

Wow, now we get to ask them questions again.....under oath!

Produce the SEC document. All you provided was an incorrect Bloomberg article.
The NMB document is the officially accepted account. Your own MEC accepted it as fact. Your near bankrupt organization was acquired by USAirways, as was the west operating certificate surrendered.
You are lucky you were not stapled like TWA and AirTran.

Again, I have no inside info on that grievance,,,,I have been trying to find out for some time now.

Who filed it? Who denied it? Was it even denied? Is the scab union going to fulfill their DFR and peruse the grievance, or are they going to drop yet another West grievance?

And, BTW, the grievance is over a contract 2004 issue, not the company's acceptance or denial of the Nic.

If, and it is a big if I highly doubt, the company is now rejecting that they accepted the Nic, and that the Nic is status quo at LCC, well then all I can say is COLLUSION with a scab union and they are back on the hook big time.

Speaking of near bankrupt...I love the quote in this article.

Not only does it correctly state AWA BOUGHT AAA it tell how effed up AAA was, describes the Christmas fiasco, and calls AAA a second tier airline that was formed from a long string of almost bankrupt commuters in it 73 year history, before the AWA merger finally turned that around.

Now that there is good reading! A long string of near bankrupt commuters...I am still ROTFLMAO!

I can go all night Claxhole....all anyone has to do is Goolge..America West Buys US Airways, and you will get 10s of thousands of articles that say exactly that, which is exactly how it happened and was reported at the time.
