Recent updates from AMFA Nat'l and local 9 (SFO) suggest it is unlikely a consensual agreement will be reached prior to the sec 1113 hearing/trial due to begin next week. If judge Wedoff abrogates the current mechanics CBA he will likely issue a TRO to prevent a strike. AMFA nat'l has indicated their interpretation of sec 6 of the RLA grants the mechanics a lawful right to seek self-help (strike) absent a CBA. AMFA will file a suit in court to support this claim. The bottom line question is this: Which law shall prevail? Section 1113 of the BK code or Section 6 of the RLA. (Railway Labor Act). After extensive research AMFA's lawyers were unable to find an established legal precedent to cite as a reference.
 
That's the $64k question in case this happens. Nobody knows.

My guess? Contract abrogation causes widespread absences, leading to prompt shutdown (permanent), making the question academic.

completely inferior product. Super 80 sucks and was gross. Terminals gross. How many armpit super 80's you all have? With no inflight or even audio.

Not even close to the quality you get on United :up:

I think it's reprehensible for someone that works in the industry (regardless if it is UA's largest competitor) - an industry that just about everyone in labor has felt significant pain... to wish for something like you're obviously wishing for. You want 70,000+ people unemployed? What a DELETED

Moderators - I gladly accept a trip to the corn fields so i won't be tempted to read more venom from the likes of DELETED

They aren't worth it, UnitedChicago. They're just know what's coming down the road for them and they're angry and nervous......
 
There's no definitive answer to this question - it's an issue of first impression for the court.
 
Wasn't the precedent set in the early 1980s when CO (Lorenzo) declared bankruptcy and immediately had the court change the contracts and then the unions struck?
 
If the CBA is thrown out we should be able to strike. A true threat is all they understand. My check keeps getting smaller. Tilton's is getting bigger. It needs to end now. We are still working on the cuts they wanted earlier this year. What are they going to come back for when it is time to exit BK? All the wages except for the Executives are in line with the LCC's. In some cases below. I heard a rumor that Management was going to get their cuts back after BK exit. If true that is enough to shut the place down. Cuts for all or no cuts. If you can't make money in BK and don't have a plan other than TED & pay cuts then UA has no right staying in business.

I am getting pissed at management more & more each day. The front line supervisors are nothing but POS robots/puppets.

If AMFA wants to strike legal or not I'm in!!!!!

Actually we already got them back. 4% beginning in April. We took a permanent 6% cut that remains in place. Management pay has been decimated just like everyone else's, however we aren't calling for burning the place down.

Second, what bearing does management pay have on mechanic's pay? Completely different jobs. My pay as a mechanic would be crap since I don't have an A&P, yet I have other skills that lets me make what I do. There will always be someone making more than you or me, why let other people's salary bring you down?

And hey, why wait until May 10? Walk out tomorrow! You'll do us all a favor.

No. It's the Lorenzo-capades that prompted 1113 and 1114 changes.
 
We are in the "people moving business" not the "airplane fixing business".....see ya!!!

First I have done nothing to slow or disrupt the operation. What I was trying to say is that we all have to take cut like the other. Why is management so special that they should get 4% back? When I say management I mean Foremen, OM's and the next step up. These people do nothing but get in the way. Most took the job to stay clean. They have no intention of making a difference. I have seen it.

Why success sharing? We are in BK. You don't go giving out money when you can't make money. Especially $300,000+ to the CEO that is asking for cuts. I just think another paycut is not needed and a strike should follow any judge ordered change to the CBA

I will walk when it is time. If you are in management as stated above you are just taking up space. You have no authority to do anything and just collect a pay check for showing up. I haven't seen one foreman that has the b*lls to tell his OM the truth or say no.

Sorry to be so bitter. I call it as I see it. I see it everyday.

I'm an AA AMT who has worked S80's and I agree with you.They are pain in the ass to work on are are outdated technology.Just be fortunate you didn't have to fly on a Fokker 100 that AA just recently retired.My forum handle ain't goingboeing for no reason!
