Just thought everyone might want to know especially all you still to vote in fleet.
IAM just put out a notice that it may be next spring or later before any ruling is made on the CIC
The arbitration date has not changed but this was the information that was given to both parties.
Just keep this in mind now all of you who hoped for a quick soultion to the CIC.

I see the iam is already puttting a negative spin on the large no vote in philly. Doesn't this overwhelming No vote in Philly get the message across to the union.
 
So much for the union representing the wishes of the membership.
As in the past, they only represent their own agenda.

Dear Sisters and Brothers:

This summer, US Airways filed an appeal of the Machinists Unions’ District Court win that compelled the airline to go forward with the Change in Control arbitration. The arbitration is currently scheduled to begin next month. Today, the court of appeals ordered that the briefing schedule on the appeal would not begin until November 7, 2007. While this does not affect the arbitration schedule, it does mean that a decision on US Airways’ appeal is not expected until Spring, 2008 or later. In addition, any ruling by the arbitrator may be subject to a further court appeal.

You will be advised of any new developments in the case.

This was put out last night after Canale got word of the vote coming out of PHL...
The wording can be confusing but if you read it right, it is basically saying that we
(the union) are going forward with the COC in Sept. and the appeal briefing will be
held Nov. 7th. ??? How do you appeal a decision that hasn't been made ?? My guess is
USAIRWAYS knew they would lose the COC and need time to regroup. This appeal
was set awhile ago but I guess Canale didn't feel we needed to know, because it sounds
good for us to vote no. Now he puts it out with wording meant to be intimidating..WE ALL
KNOW WHAT ''UNTIL'' means.. With that being said Nov.7th is alittle over 2 months away.
Alittle sounds better than until. Also the decision may not be made til Spring. Were in Fall
now so, one more season. We may see the decision the same time we get our Profit Sharing
checks.

Your company is running from this arbitration like it is the plague. I will be coming out with a 'comprehensive monetary report' regarding any Arbitration award. I would prefer the IAM put together the monetary projections of the COC grievance but it has chose to keep things 'secret'.

Also within the 'comprehensive report' will be a schedule of 'fees, penalties, interest' that may be further awarded within any arbitration award. Remember, if your company continues to 'stall' because of the 'severe harm' it could cause on the bankruptcy stakeholders, then it may be the equivalence of having lotto winnings placed in a CD. Good things, good things ma'am.

Remember, arbitration is binding and has been agreed upon. The Supreme Court has held that the grounds are very narrow for vacating an arbitration award under federal law. Further, any reviewing court will be mindful of the standard of review applied to the RLA arbitration cases which have been characterized as 'among the narrowest known to law'.

IMO, the COC grievance is the 'silver bullet' and the IAM did well not to 'shoot its silver bullet' until it came out of the bankruptcy saloon. What we have here, right now is a draw outside the corral but the IAM has the silver bullet and your company knows the bullet can create 'severe harm'. Fleet service has been trying to get the IAM to pull the trigger for well over a year now and by holding their position and drawing together in a more unified way with one voice [see vote results], they are keeping the IAM accountable so that there is fast becoming no other alternatives for the IAM/Company to run to other than the arbitration date.
