I don't know. When I tried to file for benefits when AWA took over, it was denied because we didn't have a change of control. But if you guys can prove otherwise. Well, lets see what happens in the arbitration and go from there.

If you "win" arbitration do you think the Company will honor the arbitrators decision? Binding is binding, correct? Or...maybe a play from the honorable east pilot playbook; Cry foul and claim the arbitrators an old fool. Can I get you an Arnie Palmer with that mulligan?

The best thing about it is that the arbitration is just a bonus. Remember, fleet service isn't forced or compelled to sign a transition agreement even though your company still needs a transition. It appears to me that your company and perhaps most companies in this USA need to have their 'spirit's broken and their greed 'exercised'. Unfortunately, the unions have cushioned them by appeasing them while they offer up profanities to their own members. I mean instead of holding a fair and equitable position [which is the reasonable duty of every worker] the IAM operates as a company moutpiece and tries to spread fear by saying "even if the arbitration is awarded, it may take years to get it." So be it, should workers hold their position. Your company needs a transition. Big deal, and "Tuffa Lucka"! Unless they start recognizing and treating their workers in a fair and equitable way, it will just have to piss away tons of money by having the burden and 'financial collar' of running two separate companies.

Tim, I have a question too. If we merge with United Airlines within the next 8 months will this put off the COC? This merger would also allow CWA to refile COC with new merger.

It's binding. US AIRWAYS best chance would be to further delay the inevitable by agreeing to a deal with the IAM even after a favorable award. The IAM seems VERY willing to appease your company. For further ruling on what "Top" RLA attorneys think about this issue, then read the little snippit I posted regarding this question on the link I provided here

Once the decision is made by the arbitrator, then any award that your company does not want to pay, may force penalites, fees, interest, or fines on the continued violation. It may be the equivalent of holding the winnings of the winning lotto ticket and placing it into a CD for a short time before you can collect the mega money. Leave the crumbs for the greedy pricks.

Dunno without seeing the letter of agreement between the CWA and your company. If the language is still in there then it would certainly apply to any future COC IMO but I have not seen the sidebar letter.

I blame the union heres why, They have agreed with the company on several occasions to move the arbitration date, giving the company stall time. If the lose it will be their fault this thing shouldnt be that complicated. The only thing the company is going to do is do what they went to court and do CRY, and ask for forgiveness.


The Change of Control arbitration will be heard on September 13 and 14, 2007. Preparations for the arbitration have been ongoing for nearly two years and did not cease because of the tentative agreement. District 141 and our attorneys are eager to present our case before a neutral party. 😱

I blame the IAM. Reasoning? The IAM allowed the company control the table in bargaining. You always blame the SOURCE.

Yep I think the IAM is confused.Now there eager to go for the COC...du..what :down: :down: :down:
 
I have requested attorney' on a website to refer to the AWA current TWU contract as having a condition to continue Section 6 along side the arbitration. The West deserves representation actively proceeding along with East COC. I have written Bill Chandlee our west representative also with this request. It is apparent that our TWU contract requires representation during this time.
