It's binding. US AIRWAYS best chance would be to further delay the inevitable by agreeing to a deal with the IAM even after a favorable award. The IAM seems VERY willing to appease your company. Once the decision is made by the arbitrator, then any award that your company does not want to pay, may force penalites, fees, interest, or fines on the continued violation. It may be the equivalent of holding the winnings of the winning lotto ticket and placing it into a CD for a short time before you can collect the mega money. Leave the crumbs for the greedy pricks.

The government, Arbitrator, has the last word. The new US Airways will go ahead at this point. All parties will Scramble and waste precious monies, but the government will prevail. Stop, second guessing. This airline has to play the rules. We, don't really fit. We're all players.

Let's now wait for the government that has been bombarded with airlines requesting for help with the ATC to reduce costs, that the Arbitor, will look favoribly on a Union or look for decisions that make America's airlines the leaders in the global industry. I don't think the little guys have anything to say on the issue. Neither, the CEO' of US AIRWAYS! The US government will dictate the results of our airline. We are the players!

They just almost sold your souls to the devil and now they are eager? What a joke!
The IAM was forced to go to arbitration. They wanted NO PART OF IT. The membership is the reason why the IAM is finally enforcing the grievance. Hayden/Canale/Parker agreed to throw the grievance down the toilet.

Actually Tim the arbitration was never cancelled the M&R was proceding with it no matter what fleet did.

It is a joint arbitation case between bot districts, no matter what fleet did, M&R is going full steam ahead with it.

My majic "8" ball says the IAM will loose the COC arbitration case. The announcement will be made between Thanksgiving and Christmas. Then sit back and watch THE MOTHER OF ALL MELTDOWNS.

principal amount at maturity. less than $343.61 per $1,000 principal amount at maturity. For this purpose, "fair market value" means 95% of the market price of US Airways Group common stock calculated as the average closing prices over the five business days ending on and including the third business day before the purchase date.
 
I have no dog in this fight, but I'm pretty sure the SEC's definition of Change of Control doesn't mean anything in this matter. Wasn't Change of Control defined in the IAM agreement? What does it say there?

You say that you're "pretty sure"? :lol:

I dare say that it will mean PLENTY to the Arbiter what the SEC says concerning the COC.

I have the IAM agreement right in front of me, and I can see why the company put their
tails between their legs last February, and ran away from arbitration.
 
I confronted Dougweiser With The SEC filings at the CLT Town Hall Meeting earlier this
year. His reply was "I'm going to have to get a better lawyer to dispute that".
Maybe he needs a magician!!
 
You know,

Technically all groups will be able to benefit from the establishment of Change
of Control. Being that we technically worked for a different airline, eligible employees
can get retirement benefits from the old USAirways while working for the new USAirways.

The change of control is only for wages, nothing else.
