Injunction Hearing in CLT

Anyone have any info on the hearing in CLT concerning the possible injunction? Where, when, etc? Hopefully some local pilots can attend and report back details of the hearing.

USAPA Comm., as usual, is silent.

Yesterday United States Magistrate Judge David Keesler granted US Airways' request for the Plaintiff’s Motion For Leave To Exceed Page Limits For Its Brief In Support Of Motion For Preliminary Injunction.”

The Judge said, "This motion has been referred to the undersigned Magistrate Judge pursuant to 28 U.S.C. § 636, and immediate review is appropriate. Having fully onsidered the motion and the record, the undersigned – reluctantly, and subject to the admonition below – will grant the motion. The instant motion was filed contemporaneously with numerous other documents, including: the “Complaint For Injunctive Relief” (Document No. 1); “Plaintiff’s Motion For A Preliminary Injunction” (Document No. 10); “Plaintiff’s Motion For Status Conference And Expedited Scheduling Order For Plaintiff’s Motion For Preliminary Injunction” (Document No. 21); and of course, Plaintiff’s “Brief in Support of Plaintiff’s Motion for Preliminary Injunction” (Document No. 11). As an initial matter, the undersigned observes that Plaintiff’s request to exceed page limits should have been filed in advance of filing a brief exceeding the page limits."

US Airways' request to file additional exhibits to support its case and for US Airways' lawsuit to be placed on the fast track has been granted by the federal court; however, hearing dates have not been scheduled.

Thanks for that info...but I was looking for a little more than a "page length" motion! I would think the "fast track" would be the norm in such a case.

I was not impressed with the injunction, though I am not even an outhouse lawyer. Seemed to me to be poorly written..actually asking the court to stop pilots from "writing up maintenance items??????" Maybe it is good enough, I am sure those that wrote it have some experienced help.

As to the increased taxi time in CLT....I seem to remember RNY 23 being closed for a couple of months. Even with it open the ramp has been a mess lately, poorly controlled and log jammed over near the exit from the Regional gates. I guess the union can address those issues in its written reply.

I thought the same thing, who wrote this and by wanting to go back to "status quo" isn't the company telling on themselves that they did not operate properly prior to May 1st? Can't call in fatigued was another good one!

The company says that they adjusted their figures for the weather and runway conditions, but I wonder if they have ever seen the taxiways in CLT. They are damn near gravel roads in places! Holes so bad the red mud is seeping through.

Taxi times are historical. They go back months. Consistent factors like your alleged taxiway conditions all blend into the baseline data. No wonder you're unimpressed with the data - you're to stupid to understand it.

The taxiways have been deteriorating steadily for a while. I think the winter did a lot of damage that is showing up. But then again, you don't taxi the aircraft, do you?

I've never said anything about block times, as anyone dragging their feet has a target on their back. Like a certain westie......

How about addressing my point, the write ups and calling in fatigued, since you have shown everyone on here how intelligent you are.

I wouldn't doubt the company's numbers if I were running USAPA, that's what they do. I would put out a straight forward call to the members to cease any illegal activity now. But I would fight the true safety issues to the max.

It's not my job to convince the judge. I doubt he will ask me. I hope you guys and CM get all you have coming to you.............dot every i and cross every t boys.

The profered "injunction" is simply an "opener" and should contain most any wishful item so as to not "miss anything". The fact that you seem to not know that sends your credibility to the bottom of the trailer trash list. BTW, you got a flat tire.

I've read the request for injunction, brain surgeon. I don't know where the rest is. You know, USAPA keeps us in the dark unlike AOL that force feeds you WHAT THEY WANT. Where do you think I got the questions about what they are asking? You think they will just take the FDML out of the airplane? Maybe give it to the gate agents?

I need to take a deep breath here. I know this is my calling - to spread the truth to the east no matter how stupid that individual may be. I can and will knock the stupid out of these easties.
