This incompetent fool could not settle a grade school playground dispute!!!!! Three years later and nothing?? What would happen if we fixed airplanes with the same urgency that he mediates?? If he can not get us to a settlement by now then he should have to release us!!! Call him! Write him and tell him to do his job or release us!!!
 
On Friday August 12, 2011, Co-Chairs Larry Pike, President Local 567 and ATD Representative Don Videtich of the TWU M&R Negotiating Committee met with NMB Mediator Jack Kane and Senior Mediator Larry Gibbons along with AA management.
 
Mediator Jack Kane informed Co-Chairs Larry Pike and Don Videtich, as well as American Airlines management, that due to the amount of time expended in these mediated sessions, insufficient progress, and insufficient hope for progress, the NMB could not justify scheduling future mediated sessions at this time.
 
As a general rule, the NMB does not provide consistent mediation dates unless the NMB feels the parties are close to an agreement.
 
The NMB’s decision not to participate in further bargaining at this time is in line with what occurred with the APA, where the NMB have also pulled their mediators from ongoing bargaining between the pilots and US Airways.
 
The M&R Committee and AA Management have agreed to continue meeting without the NMB Mediators involvement. We anticipate meeting with AA Management in the near future. When the meeting dates are scheduled, we will update the membership.

I agree with you. And I do not think the NMB is to blame. I think the NMB was prepared to declare impasse and BOTH sides did not want a release.
But with secret behind closed doors negotations where negotiators are threatened with removal if they speak the truth, then who the hell knows what really happened here.

Harassment of a Federal Official is a tactic of a thug, not the action of a professional seeking representation and respect.
I am not sure why the emotional outburst to blame the NMB, we have been complaining about the TWU for over 20 years now.
AA refuses to meet the demands of the TWU, and the TWU has no strength to challenge. What does the NMB have to do with that?

Therefore, any NMB mediator will do just what Kane is doing, nothing.

Maybe when Little or Phat Don gets back from the next secret meeting with company at some 5 star resort in the islands with plenty of booze and whores will we possibly have another twu sellout concessionary T/A to vote NO on.

I figure it's about that time for Little or maybe even Phat Don to make another "Without Further Ratification" agreement.

As Phat Don said; "We need to move toward the CompAAnies side ".

If it can; don't be surprise if they choose to go that route.
 
I think FURP is mistaken about the role of a mediator. He's not a judge or an arbitrator. He's there to facilitate. Pushing one side or the other towards common ground isn't his job -- it is to try and keep the conversation going.

If he's declaring that there is "insufficient progress, and insufficient hope for progress," then maybe, just maybe, the problem is with the two parties involved.

If you want someone to split the differences, request binding arbitration.

If you want someone to make the decisions for the two parties, wait long enough and you'll probably get your wish in front of a judge.

finally some sense from someone. BEFORE there is a release, there will be (as has been done in the past with AA and others) an offer of binding arbitration to the ITEMS that are still in dispute (open). The offer is not contingent on any membership vote (we gave the negotiating committee the authority to bargain). All this BS about Mr. Kane is sophmorefic babbling by supposedly grown men. The process continues under mediation, like it or not.

as matter of fact YES HE SHOULD! Goes without saying our "union" sucks. However the mediator FAILED TO DO HIS JOB !!

If I remember correctly, when the company first started low balling us on compensation the mediator told them they needed to be more realistic. Then shortly after that, told TWU they needed to be more realistic. Sounds to me like he was there just to get his pay check. Peckerwood!

Byhaps I'm mistaken (it wouldn't be a first), but I seem to remember that binding arbitration is offered either immediately before or immediately after an impasse is declared by the mediator - and BOTH parties must agree to it.

There doesn't seem to have been any request made by either party for an impasse to be declared, starting the 30 day clock as was done earlier (quickly and quietly withdrawn) by our wonderous "leader" since the first request was strictly for appearances' sake, in order to show how "serious" he was about obtaining an agreement.

So - we basically have an impasse, acknowledged by Kane but since neither party requested release, none was given - is that the basics of this mess?

For someone that's obviously in bed with the company along with his VPs, Little can't manage to do much correctly at all.

Tune in again next week, same time, same channel, to find out how much didn't happen.
