The RPA lawsuit appeal was heard by a 3 Judge appelate panel, 2nd District in the Federal Courthouse on 6 July at 2 pm, lower Manhattan. This court is just below the Supreme Court in terms of significance in the Court system. In attendance were about 25 TWA F/As and 15 AA F/As. The main plaintiff Ms. Lindsay introduced herself to all. Both groups of F/As sat behind the plaintiffs attorney Emily Bass. AA argued that they were in dire straights, about to go bankrupt and "poor me" issues at the time of the RPA. There is plenty of evidence this was not so. The plaintiffs attorney argued case law that APFA and AA are subject to case law RPA or no RPA, throughout her presentation. She was granted an additional three minutes for further presentation by the panel which appeared impressed with her knowledge of and case law about the Railway Labor Act. Twop days to six months for a decision. May plaintiffs prevail in the interest of justice.
