Overall, this is clearly a "victory" for the West, but not one where the West should be gloating. I anticipate there will be repucussions from the East. I think Doug is about to find out why mergers have a heavy price - a price that a number cruncher will never recognize until reality hits him square in the head.

What the heck...things were not rosy at AWA anyway. A BK was probably inevitable and all the merger did is delay the instability. From what I can tell from this list, Doug had better be prepared for some venting on the East side.

If all this is true, then the JNC is in trouble. East will be ready to put all the chips on the table and bet double or nothing on the next contract. But on the West, pilots will be scared to loose all their winnings and be inclined to not push for much.

BTW, has an arbitration decision EVER been overturned (I'm asking, I honestly don't know). I imagine it could be appealed in the court system, but the chances of a decision in your (east) favor is likely VERY small. May be best to just move on (easy for me to say, huh...) 😉

You can get on to any US Federal Court of Appeals circuit and search for decisions. In short, the federal courts want nothing to do with administrative decisions. An arbitrator's award can be overturned, but the standard of proof is something close to clearly erroneous such that no reasonable person could possibly come to that conclusion. Ergo...reversals never happen.

I'm trying to get this onto the clipboard but it only takes one page at a time. The opinion is 33 pages. I'll keep trying.

Definately a bitter pill, and having endured the speculation back when the U-UAL deal was in play, I know the anger and frustration from just the discussion. Keep in mind, ALPA didn't do it. ALPA made the "rules" that we all voted for thru our reps, but the decision was by an arbitrator. If you think you got screwed in the ALPA deal, just think how the non union folks at Reno and Morris felt.

If you don't like the rule, lobby to change it. Quiting ALPA only hurts your cause and gives Doug more power.
