Have you ever noticed when one goes to the US Airways website and clicks on the investor relations tab under the About Us Airways tab, one automatically gets rerouted to the AWA Investor page. HHMMmm...............
and on a related note under the FAQ's #6 In what year and where was US Airways Group, Inc. incorporated?
A. US Airways Group, Inc. was formed September 27, 2005 as a Delaware Corporation.

US Airways group has been around a lot longer then that, the date is the new US group.

It reincorporated.

how does one "re-incorporate"???
if they did there would still be 2 union seats on the board, HQ would be in CCY, Parker could be new CEO, but it would be the same old thing as before....
How do you explain the AWA investor page????

The union seats were three not two and they were removed in the last round of concessions.

HQ can be anywhere.

Delaware has very corporate friendly laws of Incorporation. Maybe the old US was a PA corporation, or a VA corp... AWA was a Delaware Corporation.

For the business it makes sence to incorporate in Delaware because the laws are much more favorable than say, California, or Massachusetts. They don't even have to maintain an office there.

LCC reincorporated by merging the old USAirways into America West. America West then changed its name to USAirways.

Essentially, the old USAir exists only as an operating certificate. Why the AWA investor page? Because America West is the surviving corporation (even though its name changed to USAirways).

There are plenty of other ways to reincorporate, but the merger of the corporation into a Delaware corp (US into AWA) is an easy way to do it.

that is what we on this side have been thinking, the old US and HP were merged into the new US, a new holding company that kept the name, that explains the "born on date" of 27sep2005, with the awahc being the principle of the NEW US holding comapny... therefore hoe accurate is it to say that the POR has to be followed because the old US does not exist on paper anymore??? and to that how is the IAM CBA automatically declared the winner, it was made with a company that no longer exist, on paper.

Because the merger and all its plans were in the POR which has to be followed by law.

And SCS grants the IAM CBA covers all. Past practice and years and years of precedents.

where in the SCS ruling does it state that the IAM CBA is the only option

Do you have comprehension problems?

When SCS is granted the union that gets it CBA is the one everyone falls under.

PSA and PI, both went under the US IAM CBA, as did Trump Shuttle.

TWA employees went under the AA contract.

Republic employees under the NWA contract.

Do I need to continue?
