I honestly do not understand why the APA is going down the litigation path with this. There is so much attrition coming up. All they have to do is fence the East off for 5 yrs and they have it all.

APA does not want our NB Reserve Captains senior to their WB  Captains regardless of any fence.

Arbitration gives APA what they want,  minimum liability and slotting by equipment and status.

APA is not going to fold to USAPA demands to avoid arbitration.

No, I am not buying your idea as what they will do in the end. Arbitration gives something else: the great unknown. The APA needs to watch that real estate show where the people bid on empty houses at the courthouse. Then they open the doors after buying it, and it turns out the plumbing is gone, gang bangers have hung out, there is fluorescent green shag carpet, and termites.
OR, the place is beautiful.
They could easily get something very bad. Not worth the risk.

What USAPA wants is definitely bad for them.

They are not going to fold to USAPA's demands to avoid arbitration.

Contempt of court. Brilliant.
Well well, one of the confused Legionnaires of Leonidas just got up off the floor after the bomb went off.
And already has it wrong.

dictum

n. Latin for "remark," a comment by a judge in a decision or ruling which is not required to reach the decision, but may state a related legal principle as the judge understands it. While it may be cited in legal argument, it does not have the full force of a precedent (previous court decisions or interpretations) since the comment was not part of the legal basis for judgment. The standard counter argument is: "it is only dictum (or dicta)."

I believe it's a head-fake, too. The AA guys are smart enough to know that arbitration is not the way to go.
. Same here, I think they could get slammed in arbitration, can't believe the APA would put their pilots in this high risk position.

Arbitration now.  apa pilots will soon learn the important difference between a gavel and a stapler.

A whining little missive from your scab lawyers is a surprise? Hardly. Yawn.

West meltdown coming.
Here's your meltdown....

"Good. Let USAPA argue and delay Judge Silver's decision until after USAPA is gone. "

"I think her comment regarding the courts patience with USAPA will be reflected in her next ruling"

"Once again USAPA over-reaches rather than respond to the companies' rule 60 they try to get even more language changed. Bonus they fulfill Silver's prediction that they would argue the other side when it suits their needs. Beautiful! As a bonus they gave the West Pilots an excuse to use USAPA updates as exhibits. Updates that show contempt for her ruling. Silver is under no obligation to rule. She can wait for decertification and then pile on while they are down."

Leonidas has a t-shirt for you.

"Dud"? There's no question that's the most completely appropriate T-shirt leo's ever put up. 😉
