Together, the CBA and the company will evaluate their liability in seniority methods. Fairness is not a consideration, but having an agreed to and accepted arbitration will be. I wonder what course our new CBA and AAL will do? Hmmmmm

What contractual provision allows or requires use of the Nic (by anyone?). Bwahhahaha.

Interesting conundrum. In Silver's decision, the one USAPA is gushing over, she states that USAPA disappears once APA comes in. The APA agrees. USAPA is not included in SLI because the company and APA have a Judges decision backing them - the one USAPA never appealed.

Wonder if there is a difference between the membership voting in a change vs the NMB mandating one? Especially since Silver ruled repeatedly Usapa was not bound by the Nic nor did she anywhere mention sucessorship or the APA even dicta saying Usapa WAS to go away?

Those are musings btw.

USAPA abandoned the Nic. Judge Silver assumed that USAPA had a duty NOT to abandon the Nic, and still couldn't find them in breach. You had your ripe trial, on the merits.

Now that all previous agreements are a nullity, name one single document requiring use of the Nic... Just one. Bwahahahahahah.

Over and again the courts have refused to intervene and have once again affirmed the right of USAPA to bargain. The West has never come to grips that their own implicit assumptions have never been binding on anyone. Bwahahahahahahaha!

Both of the defendants (USAPA and the company) prevailed and the court took absolutely no action against either of them. None.

Neither defendant has anything to appeal.

The plaintiff did not prevail and is free to spend their own money on an appeal. Pull out your credit card and make your "leaders" rich(er)!!

It would appear to me that the APA announcement is just a ploy to get a quick agreement on the seniority issue and the west pilots are doing their best to convince all that the APA will doing all the negotiating for the seniority for all the pilots. If this is so then MB would mean nothing. I'm waiting for the usual east pilots to start pressing for a quick deal. Maybe we should ask Chippy what to do .......I think we know his answer.....rollover fast!
