If I were an AOL contributor I would have to look at it this way,
Judge Silver really dislikes USAPA for whatever reason, her local in PHX, maybe she has a neighbor that is west, whatever......Now considering how much she dislikes USAPA she still could not find any legal reason for them to lose the case. She could not find anything that invalidated the MOU, and she could not find any way to place the west as a third party to the SLI, and she could find no way to force the NIC.
That means that she did the research and saw that anything she did in the above items would have been overturned upon appeal. The MOU was voted on by all and passed by all with west representation involved in that process. I think she saw that legally both sides voted to amend their positions and move on.
The fact that Silver clearly wanted to see USAPA lose as shown in her various statements in court and Dicta but could not legally find a way to make that happen tells volumes to somebody that may be considering sending more money for further litigation on the subject. Whether they choose to see that point is a different story though.
